As modificações interpretativas na regulação do uso da força: uma análise dos principais argumentos justificadores da intervenção humanitária entre 1990 e 2011 e a criação de um novo viés estrutural

Abstract

A tese possui como tema a correlação entre os argumentos justificadores da intervenção humanitária e a reconfiguração da proibição do uso da força. Como delimitação ao tema proposto, considerou-se somente a análise dos argumentos justificadores do uso da força militar com fins explicitamente humanitários em casos selecionados, que tenham sido autorizados ou não pelo Conselho de Segurança após 1990. Buscando responder ao questionamento de se os argumentos justificadores da intervenção humanitária alteraram o viés estrutural original da Carta da Organização das Nações Unidas acerca do uso da força militar, fomulou-se a resposta preliminar de que houve uma transformação na regulação do uso da força baseada em um novo viés estrutural, observável a partir das práticas institucionais do Conselho de Segurança e dos desvios da regulação textual prevista na Carta da Organização das Nações Unidas. Foram identificados quatro argumentos que serão estudados neste trabalho a partir de cinco casos selecionados. Dada a natureza desta tese e a pergunta de pesquisa aqui formulada, será utilizada a análise de conteúdo como método para compreender os interesses dos envolvidos, as interpretações dadas às normas da não intervenção e proibição do uso da força e como os demais sujeitos reagiram às interpretações apresentadas pelos intervenientes. A análise proposta valeu-se do estudo de tratados internacionais, registros de reuniões e resoluções do Conselho de Segurança da ONU e relatórios de organizações internacionais principalmente do CS - , pronunciamentos oficiais dos governos e demais documentos legais. Ao final, verificou-se a uma transformação interpretativa acerca do uso da força para fins humanitários, evidenciada pela existência em um novo viés e advindo de práticas institucionais e desvios da regulação textual da Carta, confirmando-se assim a hipótese estabelecida.

Abstract: The thesis discusses the correlation between the discourses that seek to justify the practice of humanitarian intervention and the reconfiguration of the prohibition of the use of force. The scope of this discussion will be restricted to the analysis of the discourses that explicitly justify the use of military force for humanitarian purposes in selected cases and which have been authorized or not by the Security Council after 1990. Seeking to answer the question as to whether these justifying discourses have altered the original structural bias of the Charter of the United Nations on the use of military force, it has been initially theorized that there has been an alteration of the original structural bias, generated from institutional practices (mainly from the Security Council practice) and deviations from the textual regulation provided by the UN Charter. Four discourses have been identified and they will be tested against five selected cases. Given the nature of this thesis and its research question, I will use the discourse analysis as a research method, in order to understand the interests of the parties, the interpretations of the rules of non-intervention and prohibition of use of force and how the other subjects reacted to interpretations presented by the interveners. The proposed analysis is based on the study of international treaties, records of formal meetings and resolutions of the UN Security Council and reports of international organizations, official pronouncements of governments and other legal documents.
