A proteção de crianças e adolescentes no ambiente digital: prevenção das violências e literacia digital à luz do Projeto Conhecer para se Proteger

Abstract

A crescente centralidade do ambiente digital na vida de crianças e adolescentes, associada à ampliação de riscos, violências e vulnerabilidades próprias desse contexto, evidencia a necessidade de aperfeiçoamento das estratégias de proteção jurídica desses sujeitos de direitos, o que justifica a presente investigação. Diante desse cenário, formula-se o seguinte problema de pesquisa: a proteção jurídica de crianças e adolescentes no ambiente digital pode ser efetivada também por meio de estratégias preventivas, especialmente pela literacia digital? Como hipótese, sustentase que a efetivação dessa proteção não se esgota na produção normativa ou na responsabilização posterior de condutas ilícitas, mas requer a incorporação de estratégias preventivas estruturadas, entre as quais se destaca a literacia digital como instrumento de redução de vulnerabilidades, fortalecimento da autonomia progressiva e promoção do exercício consciente de direitos. O objetivo geral consiste em verificar se a proteção jurídica de crianças e adolescentes no ambiente digital pode ser efetivada também por meio de estratégias preventivas, com destaque para a literacia digital. Como objetivos específicos, busca-se examinar a evolução da Doutrina da Proteção Integral e dos referenciais normativos aplicáveis ao ambiente digital; analisar o Princípio Responsabilidade, de Hans Jonas, como fundamento ético da prevenção; compreender as vulnerabilidades e as violências que incidem sobre crianças e adolescentes no ambiente digital; e analisar, por meio de estudo de caso, o Projeto Conhecer para se Proteger como estratégia preventiva de proteção. O estudo fundamenta-se na Doutrina da Proteção Integral, nos parâmetros internacionais de proteção dos direitos da criança, com ênfase no Comentário Geral nº 25 (2021), e no ordenamento jurídico brasileiro, especialmente na Lei nº 15.211/2025. Metodologicamente, adota abordagem qualitativa, de natureza aplicada, mediante pesquisa bibliográfica e documental, associada ao estudo de caso do Projeto Conhecer para se Proteger. A pesquisa evidencia que as violências digitais não constituem ocorrências isoladas, mas expressões estruturais potencializadas por dinâmicas tecnológicas, econômicas e culturais, revelando a insuficiência de respostas exclusivamente repressivas. Conclui-se que a efetivação da proteção jurídica no ambiente digital exige a incorporação de estratégias preventivas estruturadas, destacando-se a literacia digital como instrumento jurídico-preventivo voltado à redução de vulnerabilidades, ao fortalecimento da autonomia progressiva e à promoção do exercício consciente de direitos. O estudo de caso evidencia, ainda, a viabilidade de estratégias preventivas fundadas na articulação interinstitucional e em ações educativas, revelando o potencial desse modelo para o fortalecimento da proteção de crianças e adolescentes no ambiente digital. A pesquisa foi desenvolvida no âmbito do Programa de Pós-Graduação em Direito da Universidade Federal de Santa Catarina, inserindo-se na Área de Concentração: Direito, Política e Sociedade, na Linha de Pesquisa 4: Sistemas de Garantia, Relações Jurídicas Privadas e Processualidades, e vinculando-se ao Projeto Coletivo 4.2: Direitos Fundamentais e Proteção de Grupos Vulneráveis.

Abstract: The increasing centrality of the digital environment in the lives of children and adolescents, together with their growing exposure to the risks, forms of violence, and vulnerabilities specific to this context, underscores the need to improve legal protection strategies for these rights-holders, thereby providing the rationale for the present study. Against this background, the following research question is posed: can the legal protection of children and adolescents in the digital environment also be secured through preventive strategies, particularly digital literacy? The hypothesis advanced is that the effective realization of such protection cannot be achieved solely through lawmaking or ex post accountability for unlawful conduct; rather, it requires the incorporation of structured preventive strategies, among which digital literacy stands out as a means of reducing vulnerabilities, strengthening progressive autonomy, and promoting the informed exercise of rights. The general objective is to assess whether the legal protection of children and adolescents in the digital environment can also be secured through preventive strategies, with particular emphasis on digital literacy. The specific objectives are to examine the development of the Doctrine of Comprehensive Protection and the normative frameworks applicable to the digital environment; to analyze Hans Jonas?s imperative of responsibility as an ethical foundation for prevention; to understand the vulnerabilities and forms of violence affecting children and adolescents in the digital environment; and to analyze, through a case study, the Conhecer para se Proteger (Learn to Protect Yourself) Project as a preventive protection strategy. The study is grounded in the Doctrine of Comprehensive Protection, international standards for the protection of children?s rights?with particular emphasis on General Comment n. 25 (2021) on children?s rights in relation to the digital environment?and the Brazilian legal framework, especially Law n. 15.211/2025. Methodologically, this applied, qualitative study combines bibliographic and documentary research with a case study of the Conhecer para se Proteger Project. The study demonstrates that digital forms of violence are not isolated incidents but structural manifestations intensified by technological, economic, and cultural dynamics, thereby revealing the inadequacy of exclusively repressive responses. It concludes that the effective legal protection of children and adolescents in the digital environment requires the incorporation of structured preventive strategies, with digital literacy serving as a legal and preventive instrument aimed at reducing vulnerabilities, strengthening progressive autonomy, and promoting the informed exercise of rights. The case study further demonstrates the feasibility of preventive strategies based on interinstitutional coordination and educational initiatives, revealing the potential of this model to strengthen the protection of children and adolescents in the digital environment. The research was conducted within the Graduate Program in Law at the Federal University of Santa Catarina, under the Area of Concentration in Law, Politics, and Society and Research Line 4: Guarantee Systems, Private Legal Relations, and Proceduralities, and is affiliated with Collective Project 4.2: Fundamental Rights and the Protection of Vulnerable Groups.
