Abstract: Partindo de uma perspectiva crítica, a presente dissertação tem como objetivo analisar o instituto da adoção internacional na República de Angola à luz da Convenção da Haia sobre a Proteção das Crianças e a Cooperação em Matéria de Adoção Internacional, identificando seus limites normativos, suas fragilidades institucionais e a ausência ou insuficiência de princípios e instrumentos jurídicos diante da legislação internacional, no período compreendido entre 1975 e 2026. A análise é desenvolvida em conjunto com a Declaração dos Direitos da Criança, a Convenção sobre os Direitos da Criança e a Declaração Universal dos Direitos Humanos. O recorte temporal tem início em 1988 e se estende até 2026, de modo a contemplar dados, documentos e alterações normativas recentemente publicados. Busca-se examinar a construção e a implementação da adoção internacional nos ordenamentos jurídicos nacional e internacional, suas condições, efeitos, benefícios e entraves, especialmente diante da recente integração de Angola ao sistema de cooperação estabelecido pela Convenção da Haia. A pesquisa insere-se no campo do Direito Internacional Privado, em articulação com o Direito da Criança e do Adolescente e com o sistema internacional de proteção dos direitos humanos. Apresenta aderência à área de concentração Direito, Estado e Sociedade, do Programa de Pós-Graduação em Direito da Universidade Federal de Santa Catarina, especialmente à linha de pesquisa Historicismo, Conhecimento Crítico e Subjetividade, ao promover uma análise crítica, histórica e jurídico-institucional da formação, da evolução e da aplicação das normas relativas à adoção internacional. Vincula-se, ainda, ao projeto coletivo de pesquisa Direitos Humanos, Antropologia e História da Cultura Jurídica, coordenado e integrado pelo orientador, Professor Arno Dal Ri Júnior, na medida em que examina a proteção internacional da criança, a formação histórica da cultura jurídica angolana e a incorporação de normas internacionais ao ordenamento jurídico interno. O estudo aborda a deficiência estatal na promoção da adoção transfronteiriça de crianças e adolescentes que não são contemplados pela adoção nacional durante o período de acolhimento institucional e que, muitas vezes, atingem a maioridade sem o efetivo exercício do direito à convivência familiar. Nesse contexto, examinam-se as responsabilidades do Estado, os mecanismos de cooperação entre países de origem e de acolhimento e a necessidade de implementação de salvaguardas destinadas a assegurar o melhor interesse, a proteção integral e a dignidade da criança. A investigação adota abordagem qualitativa, jurídico-doutrinária e analítica, com utilização do método dedutivo e caráter exploratório, justificado pela escassez de estudos específicos sobre a adoção internacional em Angola. Foram examinados textos legais, convenções internacionais, documentos oficiais, produções doutrinárias, artigos científicos, publicações empíricas, decisões judiciais e relatórios de organismos internacionais, especialmente da Organização das Nações Unidas e do Fundo das Nações Unidas para a Infância. Os procedimentos de coleta de dados compreenderam pesquisa bibliográfica e documental, mediante consulta a fontes já publicadas, legislações nacionais e internacionais, jurisprudência de tribunais nacionais e estrangeiros e documentos institucionais. A incorporação de estudos de caso permitiu aproximar teoria e prática, contribuindo para a identificação de lacunas normativas, deficiências administrativas e fragilidades institucionais que dificultam a efetiva proteção da criança e a realização segura das adoções transnacionais. Os resultados demonstram que, embora a adesão de Angola à Convenção da Haia represente relevante avanço no sistema de proteção infantil, ainda permanecem obstáculos relacionados à dispersão normativa, à insuficiência de procedimentos administrativos, à ausência de mecanismos adequados de cooperação internacional e à necessidade de fortalecimento das instituições responsáveis pela adoção. Conclui-se que o aperfeiçoamento dos marcos legislativos e institucionais, a criação de instrumentos de controle, acompanhamento e cooperação e a adoção de políticas públicas de incentivo responsável à adoção internacional podem contribuir para assegurar o direito à convivência familiar às crianças e aos adolescentes não contemplados pela adoção nacional, sempre em observância ao princípio do melhor interesse da criança e às salvaguardas estabelecidas pelo Direito Internacional.Abstract: Based on a critical perspective, this dissertation aims to analyze the institution of international adoption in the Republic of Angola in light of the Hague Convention on Protection of Children and Co-operation in Respect of Intercountry Adoption, identifying its normative limitations, institutional weaknesses, and the absence or insufficiency of legal principles and instruments in relation to international legislation during the period from 1988 to 2026. The analysis is carried out in conjunction with the Declaration of the Rights of the Child, the Convention on the Rights of the Child, and the Universal Declaration of Human Rights. The temporal scope begins on November 11, 1975, the date of the independence of the Republic of Angola, and extends to 2026, in order to encompass recently published data, documents, and legislative developments. The study seeks to examine the construction and implementation of international adoption within national and international legal systems, as well as its conditions, effects, benefits, and obstacles, particularly in view of Angola?s recent integration into the cooperation system established by the Hague Convention. The research is situated within the field of Private International Law, in conjunction with Child and Adolescent Law and the international system for the protection of human rights. It is aligned with the concentration area of Law, State, and Society of the Graduate Program in Law at the Federal University of Santa Catarina, particularly with the research line Historicism, Critical Knowledge, and Subjectivity, as it develops a critical, historical, legal, and institutional analysis of the formation, evolution, and application of rules governing international adoption. It is also linked to the collective research project Human Rights, Anthropology, and the History of Legal Culture, coordinated and developed with the participation of the dissertation supervisor, Professor Arno Dal Ri Júnior, insofar as it examines the international protection of children, the historical formation of Angolan legal culture, and the incorporation of international norms into the domestic legal system. The study addresses the shortcomings of the State in promoting intercountry adoption for children and adolescents who are not placed through domestic adoption during their period in institutional care and who, in many cases, reach adulthood without effectively enjoying the right to family life. In this context, the dissertation examines State responsibilities, cooperation mechanisms between countries of origin and receiving countries, and the need to implement safeguards aimed at ensuring the best interests, full protection, and dignity of the child. The research adopts a qualitative, legal-doctrinal, and analytical approach, using the deductive method and an exploratory design, justified by the scarcity of specific studies on international adoption in Angola. Legal texts, international conventions, official documents, doctrinal works, scientific articles, empirical publications, judicial decisions, and reports issued by international organizations were examined, particularly those of the United Nations and the United Nations Children?s Fund. Data collection procedures included bibliographic and documentary research through the consultation of previously published sources, national and international legislation, case law from domestic and foreign courts, and institutional documents. The inclusion of case studies made it possible to bring theory and practice closer together, contributing to the identification of normative gaps, administrative deficiencies, and institutional weaknesses that hinder the effective protection of children and the secure implementation of intercountry adoptions. The findings demonstrate that, although Angola?s accession to the Hague Convention represents a significant advancement in the child protection system, obstacles remain regarding normative fragmentation, insufficient administrative procedures, the absence of adequate international cooperation mechanisms, and the need to strengthen the institutions responsible for adoption. It is concluded that improving legislative and institutional frameworks, creating instruments for oversight, monitoring, and cooperation, and implementing public policies that responsibly encourage international adoption may contribute to ensuring the right to family life for children and adolescents who are not placed through domestic adoption, always in accordance with the principle of the best interests of the child and the safeguards established under International Law.
