Abstract: Esta tese investiga de que maneira a ?razão cínica? ? caracterizada por reconhecer, absorver e estabilizar contradições ? se manifesta como obstáculo político-jurídico à regulação da maconha medicinal no Brasil (problema). Parte-se do contraste entre a exaltação da razão no projeto civilizatório iluminista, que privilegia o método científico como fonte da verdade, e o atual descompasso entre saber disponível e norma vigente. Sustenta-se que esse fenômeno de distanciamento sistemático e persistente entre conhecimento científico e a norma jurídica é produzido pela ?razão? cínica? (hipótese). A esse fenômeno, cunha-se a expressão desencontro-fático-científico. Adota-se método dedutivo, executado por raciocínio de afirmação do antecedente (Se p, então q; ora, p; logo, q) para sustentar que, se a racionalidade cínica se consolida no âmbito político-jurídico contemporâneo, então ela reconhece a autoridade da verdade científica sem convertê-la em obrigação político-jurídica, de modo que o desencontro-fático-científico resulta da própria operação cínica, que esvazia a verdade científica antes de sua normatização e obstrui a regulação da maconha medicinal no Brasil. Vincula-se à Área de Concentração em Direito, Política e Sociedade e à Linha de Pesquisa em Direito Internacional, Econômico e Comércio Sustentável. A pesquisa integra o projeto de pesquisa coletivo 'Cooperação Internacional e Regional', pois atua na fase zero da cooperação, para que Estado coopere ou harmonize normas, precisa-se primeiro superar o cinismo interno que nega a evidência científica, assim a investigação busca subsidiar debate sobre políticas públicas e instituições jurídicas, e a promover ordem internacional mais equitativa, democrática e solidária. A pesquisa desenvolve-se em três blocos analíticos, correspondentes aos objetivos específicos e à organização dos capítulos. Nos dois primeiros, delimita-se o objeto de estudo e seu contexto histórico-científico, com a análise dos fundamentos botânicos e químicos da Cannabis sativa L.. Nos capítulos seguintes, desenvolve-se o enquadramento teórico da obrigação políticojurídica e da ?razão? cínica, a partir de categorias como autoridade, modernidade, verdade racional, Estado e sujeito de direito. No capítulo final, avalia-se, por meio de análise de conteúdo, os discursos proferidos na Audiência Pública (25/04/2024) no âmbito do IAC n. 16 no STJ. Tem-se como principais resultados: reconhecimento sem implementação, recusa fetichista como forma de higienização. O ineditismo e a originalidade desta tese residem na atribuição deste distanciamento à ?razão cínica?, operando como categoria interpretativa. Esta pesquisa demonstra que a obstrução decorre de forma de vida predominantemente cínica, na qual o sistema jurídico admite a verdade científica, mas recusa normativamente suas consequências práticas. Em suma, a razão cínica como o principal obstáculo político-jurídico à regulação plena da maconha medicinal, problema de vontade política e de integridade do sistema jurídico, mais do que o simples acúmulo de evidências, a forma de vida precisa de disposição para viabilidade de limites racionais.Abstract: This thesis investigates the manner in which ?cynical reason? ? characterized by the recognition, absorption, and stabilization of contradictions ? manifests as a politicallegal obstacle to the regulation of medicinal cannabis in Brazil (problem). Its starting point is the contrast between the exaltation of reason in the Enlightenment?s civilizational project, which privileges the scientific method as the source of truth, and the current discrepancy between available knowledge and the prevailing legal norms. It posits that this phenomenon of systematic and persistent distancing between scientific knowledge and the legal norms is produced by ?cynical ?reason?? (hypothesis). For this phenomenon, the expression factual-scientific mismatch is coined. A deductive method is employed, executed through the reasoning of affirming the antecedent (If p, then q; therefore q), to assert that if cynical rationality consolidates within the contemporary political-legal sphere, then it recognizes the authority of scientific truth without converting it into a political-legal obligation, such that the factualscientific mismatch results from the cynical operation itself, which empties scientific truth prior to its normativization and obstructs the regulation of medical cannabis in Brazil. This research is affiliated with the Concentration Area in Law, Politics and Society and to the Research Line in International and Economic Law and Sustainable Trade. It is part of the collective research project ?International and Regional Cooperation? as it operates at phase zero of cooperation, since for a State to cooperate or harmonize norms, it is first necessary to overcome the internal cynicism that denies scientific evidence, thus the investigation seeks to inform the debate on public policies and legal institutions, and to promote a more equitable, democratic, and solidaritybased international order. The research unfolds across three analytical blocks, corresponding to the specific objectives and to the organization of the chapters. In the first two, the object of study and its historical-scientific context are delimited, with analysis of the botanical and chemical foundations of Cannabis sativa L.. In the subsequent chapters, the theoretical framework of political-legal obligation and cynical ?reason? is developed, drawing from categories such as authority, modernity, rational truth, the State, and the legal subject. In the final chapter, the discourses delivered at the Public Hearing (25/04/2024) within the scope of the Incident of Assumption of Competence (IAC) No. 16 before the Superior Court of Justice (STJ) are evaluated by means of content analysis. The main findings are: recognition without implementation, and fetishistic refusal as form of sanitization. The novelty and originality of this thesis lie in attributing this distancing to ?cynical reason?, operating as an interpretative category. This research demonstrates that the obstruction stems from a predominantly cynical form of life, in which the legal system acknowledges scientific truth but normatively rejects its practical consequences. In sum, cynical reason stands as the primary political-legal obstacle to the full regulation of medical cannabis, a problem of political will and integrity of the legal system, more than the mere accumulation of evidence, the form of life requires disposition toward the viability of rational limits.
