O que importa para quem cria a lei penal?: um estudo de caso dos fatores de influência sobre o processo legislativo do Pacote Anticrime (PL 10.372/18, PL 10.373/18 e PL 882/19)

Abstract

Esta dissertação apresenta um estudo sobre os fatores de influência sobre o processo legislativo do Pacote Anticrime de 2019 (PL 10.372/18, PL 10.373/18 e PL 882/19). Este trabalho se insere no campo da política legislativa penal e integra a linha de pesquisa controle social e sistemas de justiça, vinculada à área de concentração de teoria e história do direito do Programa de Pós-Graduação em Direito da Universidade Federal de Santa Catarina. O problema de pesquisa, baseia-se em compreender como os parlamentares e o processo legislativo são influenciados e como isso impacta na produção legislativa em matéria criminal. Parte-se da hipótese de que atividade legislativa penal é orientada por uma racionalidade política, cuja compreensão é necessária para uma avalição mais precisa desse processo. Este trabalho tem como objetivo identificar quais elementos influem sobre o processo legislativo penal, os quais são nomeados como fatores de influência. Busca-se compreender (1º) os fatores de influência sobre o processo legislativo; (2º) as dinâmicas de funcionamento do Poder Legislativo e sua produção normativa em matéria penal; (3º) o processo legislativo criminal que culminou no texto final do Pacote Anticrime de 2019; assim como (4º) os principais fatores de influência sobre este processo legislativo que podem ser observados a partir da análise documental. No primeiro capítulo, essa análise foi realizada por meio da revisão bibliográfica da literatura em política legislativa penal, política criminal e ciência política. Identificou-se os fatores de influência sobre o processo legislativo já mencionados pela bibliografia consultada. No segundo capítulo, realizou-se estudo de caso do processo legislativo do Pacote Anticrime de 2019. Os achados da revisão bibliográfica nortearam a análise dos documentos da tramitação do PL 10.372/18, PL 10.373/18 e PL 882/19 e das reuniões deliberativas do GT Penal. A partir dessa análise, confirmou-se que o processo legislativo penal opera por meio de racionalidade de caráter político e discursos simbólicos. Esse processo é influenciado por fatores como o Poder Executivo, Poder Judiciário, ?timing?, lideranças partidárias, lideranças legislativas, eleitorado, opinião pública, mídia, redes sociais, fatos de grande repercussão social e variados grupos de interesse como juristas e especialistas. Os resultados apontam que a produção legislativa criminal é marcada pela superficialidade dos debates, baixa reflexão, falta de rigor científico no diagnóstico e na elaboração, assim como pouca ou nenhuma análise da eficácia das leis e políticas públicas em matéria criminal.

Abstract: This dissertation presents a study of the factors influencing the legislative process of the 2019 Anti-Crime Package (PL 10.372/18, PL 10.373/18, and PL 882/19). This work falls within the field of criminal legislative policy and is part of the research line on social control and justice systems, linked to the area of concentration in legal theory and history within the Graduate Program in Law at the Federal University of Santa Catarina. The research problem centers on understanding how lawmakers and the legislative process are influenced and how it impacts legislative output in criminal matters. The study is based on the hypothesis that criminal legislative activity is guided by a political rationale, the understanding of which is necessary for a more accurate assessment of this process. This study aims to identify the elements that influence the criminal legislative process, which are referred to as influencing factors. It seeks to understand (1) the factors influencing the legislative process; (2) the dynamics of the Legislative Branch?s operations and its legislative output in criminal matters; (3) the criminal legislative process that culminated in the final text of the 2019 Anti-Crime Package; as well as (4) the main influencing factors on this legislative process that can be observed through documentary analysis. In the first chapter, this analysis was conducted through a literature review of works on criminal legislative policy, criminal policy, and political science. We identified the factors influencing the legislative process that had already been mentioned in the consulted literature. In the second chapter, a case study was conducted on the legislative process of the 2019 Anti-Crime Package. The findings of the literature review guided the analysis of the documents related to the legislative proceedings of Bills 10.372/18, 10.373/18, and 882/19, as well as the deliberative meetings of the Criminal Law Working Group. Based on this analysis, it was confirmed that the criminal legislative process operates through political rationality and symbolic discourses. This process is influenced by factors such as the Executive Branch, the Judicial Branch, ?timing,? party leaders, legislative leaders, the electorate, public opinion, the media, social media, events with significant social repercussions, and various interest groups such as legal scholars and experts. The results indicate that criminal legislative production is characterized by superficial debates, a lack of reflection, a lack of scientific rigor in diagnosis and drafting, as well as little or no analysis of the effectiveness of laws and public policies in criminal matters.
