Title: Pioneers in the Hague: the PCIJ's role as precedent setter for international adjudication
Author: Benassi, Thales Vicente
Abstract: This dissertation explores the Permanent Court of International Justice (PCIJ) and its fundamental role in the evolution of International Law, focusing on its function as a pioneer for International Precedent in adjudication. By examining the Legal History of the early 20th century, the study traces the transition of the discipline from \"book-law\"?a collection of theoretical treatises?into a vibrant system of \"case-law\" that defines modern international law. The origins of the PCIJ are rooted in the \"professional era\" of international law initiated by the 1873 generation of jurists, whose work laid the intellectual groundwork for the Hague Peace Conferences. Following the First World War, the Advisory Committee of Jurists (ACJ) was tasked with drafting a statute for a permanent tribunal. This process required a complex negotiation between the interests of Great Powers and the principle of sovereign equality. It is argued that the core of the PCIJ?s legacy lies in its development of a body of International Precedent. Despite statutory limitations on the binding force of decisions, the Court adopted a practice of constant self-reference, effectively introducing a persuasive precedent model. Through various precedent-setting cases, the Court established the standards, definitions, and legal concepts that remain the backbone of the International Court of Justice (ICJ) today. These landmark decisions clarified the nature of international obligations and the extent of state rights, providing a stable foundation for international adjudication. Ultimately, the PCIJ represented a \"social miracle\" that successfully judicialized international disputes and provided a repository of knowledge that lends legitimacy and stability to the current international legal order.
