O aporte teológico na teoria política de Carl Schmitt

Abstract

A presente dissertação investiga a relação intrínseca entre o pensamento teológico e o pensamento político na obra de Carl Schmitt, analisando como a modernidade jurídica opera uma transposição de conceitos transcendentais para o plano da imanência. Inserida na área de concentração: Direito, Política e Sociedade, a pesquisa fundamenta-se na linha de pesquisa: Historicismo, Conhecimento Crítico e Controle Social e vincula-se ao Projeto Coletivo Direitos Humanos, Antropologia e História da Cultura Jurídica. Utilizando o método hipotético-dedutivo e pesquisa bibliográfica, o trabalho organiza-se em três capítulos fundamentais. O primeiro explora a interseccionalidade histórica entre religião e Direito, demonstrando como o sistema jurídico herda do sagrado elementos como a linguagem, a magia e os rituais para fundamentar sua autoridade. O segundo capítulo debruça-se sobre o conceito de Teologia Política e o fenômeno da secularização, investigando-a como um processo de transposição em que o Estado assume o papel de centro ordenador outrora ocupado pela divindade. O terceiro capítulo foca especificamente na obra de Schmitt e sua proximidade com o pensamento contrarrevolucionário do século XIX. Conclui-se que Schmitt operou uma transposição deliberada da estrutura organizacional e dos preceitos elementares da Igreja Católica para a sua concepção de Estado, resgatando elementos da teologia cristã para postular a necessidade de um poder forte capaz de intervir no Estado. A Teologia Política de Schmitt não emprega terminologia religiosa por estética, mas por convicção em uma equivalência lógica e histórica entre religião e Direito.

Abstract: This dissertation investigates the intrinsic relationship between theological and political thought in the work of Carl Schmitt, analyzing how legal modernity operates a transposition of transcendental concepts into the plane of immanence. Situated within the area of concentration: Law, Politics and Society, the research is based on the line of research: Historicism, Critical Knowledge and Social Control and is linked to the Collective Project Human Rights, Anthropology and History of Legal Culture. Using the hypothetical-deductive method and bibliographic research, the study is organized into three fundamental chapters. The first explores the historical intersectionality between religion and Law, demonstrating how the legal system inherits elements from the sacred, such as language, magic, and rituals, to ground its authority. The second chapter focuses on the concept of Political Theology and the phenomenon of secularization, investigating it as a process of transposition in which the State assumes the role of the ordering center formerly occupied by the divinity. The third chapter specifically focuses on Schmitt's work and its proximity to 19th-century counter revolutionary thought. It is concluded that Schmitt operated a deliberate transposition of the organizational structure and elementary precepts of the Catholic Church into his conception of the State, reclaiming elements of Christian theology to postulate the need for a strong power capable of intervening in the State. Schmitt's Political Theology does not employ religious terminology for aesthetic purposes, but rather out of a conviction in a logical and historical equivalence between religion and Law.
