Abstract: A dissertação analisa a manifestação da \"Suprema Vox\" no Direito, sendo o objetivo geral da pesquisa investigar qual dos poderes deve possuir a autoridade decisória final nos Estados Constitucionais Democráticos de Direito e de que maneira essa autoridade deve ser exercida e fiscalizada para atuar de forma justa, ponderada, imparcial e equilibrada, refletindo os valores democráticos e constitucionais. Para alcançar tal finalidade, os objetivos específicos consistem em: primeiro, compreender qual poder deve efetivamente deter a última palavra no sistema jurídico-político, à luz dos princípios da separação de poderes e dos critérios que asseguram decisões justas e imparciais, de modo a garantir um exercício equilibrado da autoridade decisória. Segundo, busca-se analisar de que forma essa autoridade decisória final pode ser exercida de maneira justa e equilibrada, observando os princípios democráticos e as garantias constitucionais. E terceiro, objetiva-se investigar os mecanismos de fiscalização e controle da atuação da denominada ?Suprema Vox?, a fim de assegurar que suas decisões sejam independentes de influências externas, preservando os valores fundamentais do Estado Democrático de Direito e a autonomia do sistema jurídico-político. Ao longo do texto, as hipóteses apresentadas são confirmadas, evidenciando que a atribuição da autoridade decisória final ao Poder Judiciário não ocorre de forma automática, mas se consolida como a solução mais recorrente, uma vez que, em tese, trata-se do Poder mais equilibrado e apto à ponderação de conflitos. Demonstra-se, ainda, que essa atuação deve ser excepcional e orientada pela busca do consenso entre os Poderes, bem como que a judicialização pode desempenhar papel relevante na proteção de direitos fundamentais, desde que não se confunda com a politização do Judiciário, a qual compromete a confiança pública e a própria função jurisdicional. A pesquisa aborda ainda temas correlatos, como os limites e as implicações da politização do Judiciário, a intervenção judicial em políticas públicas e no orçamento, e os desafios para a manutenção do equilíbrio entre os poderes Executivo, Legislativo e Judiciário. Observando-se particular atenção ao papel do Judiciário como instância final da interpretação e aplicação das Constituições, especialmente em um contexto de polarizações políticas que marcam as sociedades contemporâneas. O estudo investiga as crescentes tensões entre os Poderes e como o Judiciário atua na mediação desses conflitos, bem como na garantia dos direitos fundamentais, particularmente em questões relacionadas ao orçamento público e à implementação de políticas públicas. Metodologicamente, a dissertação adota os métodos hipotético-dedutivo, indutivo e dialético, que são complementados por procedimentos descritivos e explicativos. As técnicas empregadas incluem a análise comparativa, permitindo um estudo detalhado das dinâmicas institucionais e dos critérios necessários para a definição e atuação da autoridade decisória final no sistema jurídico-político. Essa abordagem possibilitou examinar casos específicos para ilustrar as questões discutidas e compreender as interações entre os poderes, as implicações das decisões judiciais e os efeitos dessas decisões na estabilidade institucional e no equilíbrio entre os poderes. As conclusões destacam que a cúpula do Poder Judiciário, possui legitimidade democrática indireta oriunda do processo de nomeação, e tem se mostrado o mais equilibrado dos poderes, sobretudo em momentos de intensa polarização política. Assim, o Poder Judiciário desempenha o papel de guardião do Estado Constitucional Democrático de Direito, exercido a partir da autocontenção relativa, bem como da deferência relativa aos atos dos demais poderes, logo, intervindo com prudência, quando necessário, para proteger os direitos fundamentais e a estabilidade institucional. O estudo revela que a atuação judicial deve ser tão firme quanto ponderada, contribuindo para o equilíbrio entre os poderes. A relevância da pesquisa transcende o campo teórico, oferecendo contribuições práticas para o aprimoramento e o fortalecimento das democracias contemporâneas, especialmente em períodos de crise política e social.Abstract: The dissertation analyzes the manifestation of the ?Suprema Vox? in Law, with the general objective of investigating which branch of government should hold the final decision-making authority in Democratic Constitutional States governed by the rule of law, and in what manner this authority must be exercised and supervised so as to act in a fair, reasoned, impartial, and balanced way, reflecting democratic and constitutional values. To achieve this purpose, the specific objectives consist of: first, understanding which branch should effectively hold the final word in the legal-political system, in light of the principle of the separation of powers and the criteria that ensure fair and impartial decisions, thereby guaranteeing a balanced exercise of decision-making authority. Second, the study seeks to analyze how this final decision-making authority may be exercised in a fair and balanced manner, in accordance with democratic principles and constitutional guarantees. Third, it aims to investigate the mechanisms for oversight and control of the actions of the so-called ?Suprema Vox,? in order to ensure that its decisions remain independent from external influences, preserving the fundamental values of the Democratic State governed by the rule of law and the autonomy of the legal-political system. Throughout the text, the hypotheses presented are confirmed, demonstrating that the attribution of final decision-making authority to the Judiciary does not occur automatically, but rather consolidates itself as the most recurrent solution, since, in theory, it is the branch that is most balanced and best suited to weighing conflicts. It is further shown that such action must be exceptional and guided by the pursuit of consensus among the branches of government, and that judicialization may play a relevant role in the protection of fundamental rights, provided it is not confused with the politicization of the Judiciary, which undermines public trust and the very judicial function. The research also addresses related themes, such as the limits and implications of the politicization of the Judiciary, judicial intervention in public policies and the budget, and the challenges involved in maintaining balance among the Executive, Legislative, and Judicial branches, with particular attention to the role of the Judiciary as the final instance of constitutional interpretation and application, especially in a context of political polarization that characterizes contemporary societies. The study examines the growing tensions among the branches of government and how the Judiciary acts in mediating these conflicts, as well as in guaranteeing fundamental rights, particularly in matters related to the public budget and the implementation of public policies. Methodologically, adopts the hypothetical-deductive, inductive, and dialectical methods, complemented by descriptive and explanatory procedures. The techniques employed include comparative analysis, enabling a detailed study of institutional dynamics and of the criteria necessary for exercising final decision-making authority within the legal-political system. It is possible to examine specific cases to illustrate the issues discussed and to understand the interactions among the branches of government, the implications of judicial decisions, and the effects of such decisions on institutional stability and the balance of powers. Conclusions highlight that the upper echelon of the Judiciary possesses indirect democratic legitimacy derived from the appointment process and has proven to be the most balanced branch, especially in moments of intense political polarization. Thus, the Judiciary plays the role of guardian of the Democratic Constitutional State governed by the rule of law, exercising this role through relative self-restraint as well as relative deference to the acts of the other branches, intervening prudently when necessary to protect fundamental rights and institutional stability. Study reveals that judicial action must be as firm as it is balanced, contributing to equilibrium among the branches of government. The relevance of the research goes beyond the theoretical sphere, offering practical contributions to the improvement and strengthening of contemporary democracies, especially during periods of political and social crisis.
