O presente trabalho de conclusão de curso analisa a responsabilidade civil do cirurgião plástico nas cirurgias plásticas estéticas eletivas, examinando se a sua caracterização como uma obrigação de resultado tem conduzido a uma indevida ampliação da responsabilização desse profissional. Para tanto, percorreu a evolução histórica da responsabilidade civil, desde os primórdios até a sua constitucionalização e objetivação no direito brasileiro, bem como expôs os pressupostos que estruturam o dever de indenizar, quais sejam, a conduta, o dano, o nexo de causalidade e, na responsabilidade subjetiva, a culpa ou o dolo. Investigou, ainda, a distinção entre obrigação de meio e obrigação de resultado e a natureza jurídica contratual e sui generis da relação médico-paciente, situando os direitos e deveres do profissional e a tutela conferida ao paciente. Reconheceu que, embora a responsabilidade médica seja, em regra, subjetiva e fundada na obrigação de meio, a jurisprudência do Superior Tribunal de Justiça consolidou o entendimento de que a cirurgia plástica meramente embelezadora configura obrigação de resultado, da qual decorre a presunção de culpa e a inversão do ônus da prova. Adotou o método dedutivo, partindo das premissas gerais da responsabilidade civil para examinar a sua aplicação concreta, e valeu-se de revisão bibliográfica e de análise de precedentes do Superior Tribunal de Justiça e dos Tribunais de Justiça de Santa Catarina, de São Paulo e do Paraná. Constatou que a conjugação entre o subjetivismo inerente ao resultado estético, a mitigação do encargo probatório do paciente e o rigor da prova imposta ao profissional, frequentemente próxima da prova diabólica, esvazia o elemento culpa e produz uma objetivação indireta da responsabilidade, fazendo o regime nominalmente subjetivo operar segundo a lógica da responsabilidade objetiva. Demonstrou que essa dificuldade se agrava na denominada zona cinzenta entre os procedimentos reparadores e os embelezadores, em que o fracionamento da obrigação acentua a insegurança jurídica. Concluiu que a responsabilização do cirurgião plástico deve permanecer vinculada à efetiva demonstração de culpa, sob pena de convertê-lo em garantidor de um resultado que a ciência médica não pode assegurar. This undergraduate thesis analyzes the civil liability of the plastic surgeon in elective aesthetic plastic surgeries, examining whether its characterization as an obligation of result has led to an undue expansion of this professional's liability. To this end, it traced the historical evolution of civil liability, from its origins to its constitutionalization and shift toward strict liability in Brazilian law, and it set out the elements that structure the duty to indemnify, namely conduct, damage, the causal link, and, in fault-based liability, negligence or intent. It further investigated the distinction between an obligation of means and an obligation of result, as well as the contractual and sui generis legal nature of the physician and patient relationship, situating the professional's rights and duties and the protection afforded to the patient. It acknowledged that, although medical liability is, as a rule, fault-based and grounded in an obligation of means, the case law of the Superior Court of Justice has consolidated the understanding that merely cosmetic plastic surgery constitutes an obligation of result, from which a presumption of fault and a reversal of the burden of proof arise. It adopted the deductive method, proceeding from the general premises of civil liability to examine its concrete application, and it drew on a literature review and on an analysis of precedents of the Superior Court of Justice and of the State Courts of Justice of Santa Catarina, São Paulo, and Paraná. It found that the combination of the subjectivism inherent in the aesthetic outcome, the mitigation of the patient's evidentiary burden, and the stringency of the proof imposed on the professional, often bordering on probatio diabolica, empties out the element of fault and produces an indirect objectification of liability, causing the nominally fault-based regime to operate according to the logic of strict liability. It demonstrated that this difficulty is aggravated in the so-called gray area between reconstructive and cosmetic procedures, in which the splitting of the obligation heightens legal uncertainty. It concluded that the plastic surgeon's liability must remain tied to the effective demonstration of fault, lest the surgeon be turned into a guarantor of a result that medical science cannot ensure. |
