O presente trabalho analisa a tributação de produtos de higiene menstrual no Brasil, conhecida como tampon tax, à luz da justiça fiscal, da igualdade de gênero e da reforma tributária. A pesquisa parte da constatação de que a tributação sobre o consumo, embora formalmente neutra, pode produzir efeitos desproporcionais sobre grupos socialmente vulnerabilizados, especialmente quando incide sobre bens indispensáveis à saúde, à higiene e à dignidade humana. Nesse contexto, examina- se em que medida a tributação de absorventes, tampões higiênicos, coletores menstruais e produtos similares reproduz desigualdades de gênero ou contribui para sua mitigação, considerando os princípios constitucionais da igualdade tributária, da seletividade em função da essencialidade e da capacidade contributiva. A investigação adota metodologia qualitativa, de caráter jurídico-dogmático, com base em pesquisa bibliográfica e documental, abrangendo doutrina tributária e constitucional, dados sobre pobreza menstrual, legislação nacional, experiências comparadas e alterações introduzidas pela Emenda Constitucional no 132/2023 e pela Lei Complementar no 214/2025. Verifica-se que, antes da reforma tributária, o tratamento fiscal conferido aos produtos de higiene menstrual era marcado por fragmentação normativa, ausência de uniformidade e insuficiente reconhecimento de sua essencialidade, especialmente no âmbito da tributação sobre o consumo. Conclui- se que a previsão de alíquota zero do IBS e da CBS para produtos de cuidados básicos à saúde menstrual representa avanço relevante na perspectiva da justiça fiscal de gênero. Contudo, tal medida, isoladamente, não é suficiente para enfrentar a pobreza menstrual em sua dimensão estrutural, sobretudo se não houver controle do repasse da desoneração ao preço final e políticas públicas voltadas à distribuição gratuita desses produtos. Assim, a análise da tampon tax evidencia os limites da neutralidade fiscal e reforça a necessidade de construção de um sistema tributário comprometido com a igualdade material, a dignidade humana e a superação de desigualdades estruturais. This undergraduate thesis analyzes the taxation of menstrual hygiene products in Brazil, known as the tampon tax, in light of fiscal justice, gender equality, and tax reform. The research starts from the premise that consumption taxation, although formally neutral, may produce disproportionate effects on socially vulnerable groups, especially when it applies to goods that are essential to health, hygiene, and human dignity. In this context, the study examines the extent to which the taxation of sanitary pads, tampons, menstrual cups, and similar products reproduces gender inequalities or contributes to their mitigation, considering the constitutional principles of tax equality, selectivity based on essentiality, and ability to pay. The research adopts a qualitative, legal-dogmatic methodology, based on bibliographical and documentary analysis, encompassing tax and constitutional law scholarship, data on menstrual poverty, national legislation, comparative experiences, and the changes introduced by Constitutional Amendment No. 132/2023 and Complementary Law No. 214/2025. The study finds that, before the tax reform, the tax treatment granted to menstrual hygiene products was marked by normative fragmentation, lack of uniformity, and insufficient recognition of their essential nature, especially within consumption taxation. It concludes that the provision establishing a zero rate for IBS and CBS on basic menstrual health care products represents a relevant step forward from the perspective of gender-based fiscal justice. However, this measure, taken in isolation, is not sufficient to address menstrual poverty in its structural dimension, particularly without mechanisms to ensure that tax relief is effectively passed on to final consumer prices and without public policies aimed at the free distribution of these products. Thus, the analysis of the tampon tax reveals the limits of fiscal neutrality and reinforces the need to build a tax system committed to substantive equality, human dignity, and the overcoming of structural inequalities. |
