| Title: | A eficácia do Testamento Vital no ordenamento jurídico brasileiro e sua compatibilidade com o sistema de proteção dos direitos da personalidade |

Na metade do século XX, se observou, especialmente nos Estados Unidos da América, o surgimento de um novo mecanismo jurídico, que tem como objetivo instrumentalizar e declarar formalmente os desejos dos pacientes médicos, em momentos nos quais não conseguissem fazê-lo - são as Diretivas Antecipadas de Vontade, que se concretizam, principalmente, a partir do Testamento Vital. No Brasil, muito embora a difusão desse instrumento há tempo tenha ocorrido no Ocidente, o Testamento Vital é um meio de expressão formal da vontade pouco conhecido e, por conseguinte, pouco utilizado e sua eficácia perante terceiros, sobretudo médicos e familiares, pode encontrar barreiras no atual sistema de proteção dos direitos da personalidade, consagrado pelo Código Civil. O presente estudo, nesse sentido, visou a investigar o instituto do Testamento Vital, encontrando seus fundamentos na prática internacional, analisando o panorama atual da sua utilização no aparelho jurídico interno brasileiro e identificando sua compatibilidade ao sistema de proteção dos direitos personalíssimos, em especial, a partir da sua confrontação à natureza irrenunciável do direito à vida e à integridade física, positivada pelo artigo 11 do Código Civil. A pesquisa, realizada a partir de análise bibliográfica, deu exame aos instrumentos internacionais que normatizam o tema, especialmente, o Convênio de Oviedo (1967), na Europa, e a normatização do living will, nos EUA, assim como examinou o Projeto de Lei do Senado nº 149/2018, o Projeto de Lei nº 4.869/2024 e o posicionamento da jurisprudência dos tribunais brasileiros. Ao final, o estudo concluiu que o Testamento Vital, enquanto antecipação da autonomia privada do sujeito de direitos sobre seu próprio corpo, saúde e vida, é compatível à lei brasileira, indicando ser necessária e emergente a normatização acerca do tema em âmbito federal, com a instituição das solenidades necessárias para a sua concretização, assim, garantindo-lhe validade e eficácia, que, consequentemente, implicam na sua oponibilidade erga omnes. In the mid-twentieth century, a new legal mechanism emerged, especially in the United States of America, aimed at formalizing and giving legal expression to patients’ wishes regarding medical care in situations where they are unable to do so themselves. These are the Advance Directives of Will, which are primarily materialized through the Living Will. In Brazil, although this instrument has long been disseminated throughout the Western world, the Living Will remains a little-known and, consequently, little-used means of formal expression of will. Its effectiveness before third parties—particularly physicians and family members—may face obstacles within the current system for protecting personality rights, as established by the Civil Code. This study, therefore, sought to investigate the institution of the Living Will, identifying its foundations in international practice, analyzing the current landscape of its use within the Brazilian legal system, and assessing its compatibility with the system of protection of personality rights, especially in light of the inalienable nature of the right to life and to physical integrity, enshrined in Article 11 of the Civil Code. Conducted through bibliographic research, the study examined international instruments regulating the topic—particularly the Oviedo Convention (1997) in Europe and the standardization of the Living Will in the United States—as well as the Brazilian Senate Bill No. 149/2018, the House Bill No. 4.869/2024, and relevant case law of Brazilian courts. Ultimately, the research concludes that the Living Will, as an anticipatory exercise of an individual’s private autonomy over their own body, health, and life, is compatible with Brazilian law. It also highlights the urgent need for federal regulation on the subject, establishing the formalities necessary for its implementation, thereby ensuring its validity and effectiveness—and consequently, its enforceability erga omnes. |
