A atuação do advogado nas ações de família que envolvem criança e adolescente sob a perspectiva da Doutrina da Proteção Integral

Abstract

A Doutrina da Proteção Integral reconhece a criança e o adolescente como sujeitos de direitos. Segundo a Constituição Federal, é dever do Estado, da família e da sociedade assegurar os direitos fundamentais da criança e do adolescente. Nesse sentido, faz-se necessário reafirmar e analisar de forma atenta a atuação do advogado nas ações de família que envolvem crianças e adolescentes, com o objetivo de compreender de que maneira essa atuação pode assegurar a defesa da Doutrina da Proteção Integral. Inicialmente, examina-se a evolução histórica das normativas internacionais e nacionais que consolidaram os direitos das crianças e dos adolescentes, evidenciando as transformações jurídicas, sociais e culturais que moldaram o atual modelo protetivo. Em seguida, explora-se o contexto das ações de família que impactam diretamente os direitos de crianças e adolescentes, destacando os principais desafios e complexidades enfrentados nesses processos. Por fim, investiga-se o papel do advogado nessas ações sob a perspectiva da Doutrina da Proteção Integral, enfatizando sua responsabilidade em garantir o melhor interesse da criança e assegurar que seus direitos fundamentais sejam respeitados. A pesquisa adota o método qualitativo, com abordagem exploratória e analítica, apoiando-se em revisão bibliográfica, análise documental e jurisprudencial, bem como na experiência profissional. Os resultados demonstram que a atuação do advogado transcende a mera representação técnica, exigindo uma postura ética, pedagógica, especializada e interdisciplinar. Tal configuração decorre da própria função social da advocacia, que se orienta não apenas à defesa de interesses individuais, mas também à promoção do diálogo, à prevenção da litigiosidade e à busca pela resolução consensual dos conflitos, em conformidade com a Doutrina da Proteção Integral. Por isso, a pesquisa busca trazer à luz a função do advogado em garantir o superior interesse da criança nas ações de família, apresentando, ao final, protocolos sistematizados em seis eixos que devem ser considerados no exercício da advocacia que envolve crianças e adolescentes. Conclui-se, portanto, que a atuação do advogado em ações de família que envolvem crianças e adolescentes deve estar orientada pela Doutrina da Proteção Integral, fundamentando-se em uma análise jurídica aliada a uma perspectiva humanizada dos fatos, alertando os pais da importância do exercício da coparentalidade, bem como das consequências práticas, jurídicas e psicológicas que podem advir tanto da celebração de acordos quanto da instauração do litígio, bem como acerca dos efeitos nocivos de condutas marcadas pela beligerância. Exige-se, igualmente, uma postura de contenção diante da possibilidade de fomentar conflitos, tendo em vista os relevantes prejuízos emocionais que podem ser impostos à criança ou ao adolescente diretamente envolvido na demanda.

Abstract: The Doctrine of Integral Protection recognizes children and adolescents as subjects of rights. According to the Federal Constitution, it is the duty of the State, the family, and society to ensure the fundamental rights of children and adolescents. Therefore, it is necessary to reaffirm and carefully analyze the role of lawyers in family lawsuits involving children and adolescents, with the aim of understanding how this role can ensure the defense of the Doctrine of Integral Protection. Initially, the historical evolution of international and national regulations that consolidated the rights of children and adolescents is examined, highlighting the legal, social, and cultural transformations that shaped the current protective model. Next, the context of family lawsuits that directly impact the rights of children and adolescents is explored, highlighting the main challenges and complexities faced in these cases. Finally, the role of lawyers in these lawsuits is investigated from the perspective of the Doctrine of Integral Protection, emphasizing their responsibility to guarantee the best interests of the child and ensure that their fundamental rights are respected. The research adopts a qualitative method, with an exploratory and analytical approach, supported by a literature review, document analysis, case law, and professional experience. The results demonstrate that the role of a lawyer transcends mere technical representation, requiring an ethical, pedagogical, specialized, and interdisciplinary approach. This framework stems from the very social function of the legal profession, which is oriented not only toward defending individual interests but also toward promoting dialogue, preventing litigation, and seeking consensual resolution of conflicts, in accordance with the Doctrine of Integral Protection. Therefore, the research seeks to illuminate the role of the lawyer in ensuring the best interests of the child in family law cases, ultimately presenting systematized protocols based on six axes that should be considered when practicing law involving children and adolescents. It follows, therefore, that the lawyer's role in family cases involving children and adolescents should be guided by the Doctrine of Integral Protection, based on a legal analysis combined with a humanized perspective of the facts. He or she should alert parents to the importance of co- parenting, as well as the practical, legal, and psychological consequences that may arise from both the conclusion of agreements and the initiation of litigation, as well as the harmful effects of belligerent behavior. A restrained stance is also required when faced with the possibility of fostering conflicts, given the significant emotional harm that may be inflicted on the child or adolescent directly involved in the case.
