O apelo ao legislador como indutor de um supremo tribunal federal autocontido: uma perspectiva minimalista

Abstract

A pesquisa investiga a possibilidade de o Apelo ao Legislador servir como um mecanismo de indução de uma postura minimalista do Supremo Tribunal Federal. A dissertação inicia tendo como fio condutor o Minimalismo Judicial de Cass Sunstein, o que dará todo o suporte teórico para se identificar o que é uma postura maximalista, o que é uma postura minimalista, e por qual razão esta última pode ser tida como uma alternativa institucional interessante para a democracia deliberativa. No primeiro capítulo, busca-se estudar a teoria do Minimalismo Judicial conforme desenhada por Sunstein. Seu foco será demonstrar como uma corte minimalista tende a proferir decisões rasas e estreitas, ao passo que tribunais maximalistas costumam decidir de maneira ampla e profunda. Será também abordado as vantagens do Minimalismo à luz do democracia deliberativa. Prosseguindo, no segundo capítulo será colocado sob uma lupa teórica o instituto do Apelo ao Legislador. Serão analisados qual sua origem, qual sua estrutura, sua dinâmica e os casos em que é aplicado, pelo Tribunal Federal Constitucional alemão o mecanismo em estudo. No terceiro capítulo, chegar-se-á à hipótese propriamente dita, isto é, a verificação da possibilidade do uso do instituto servir para transformar o STF em uma corte mais minimalista. Para tanto, será verificado se existem meios, já à disposição, que podem afastar o Supremo do maximalismo, bem como será analisado se tais meios são eficazes plenamente ou se o Apelo ao Legislador possui algum espaço a desempenhar um papel indutor do minimalismo no STF. O método de abordagem utilizado foi o indutivo e o método de procedimento adotado o monográfico. As técnicas de pesquisa foram a bibliográfica e a documental.

Abstract: This research investigates the possibility of the Appeal to the Congress serving as a mechanism to induce a minimalist behavor on the Supreme Federal Court. The dissertation begins with Cass Sunstein's Judicial Minimalism as a guiding principle, which will provide all the theoretical support to identify what a maximalist posture is, what a minimalist posture is, and why the latter can be considered an interesting alternative for deliberative democracy. In the first chapter, we seek to study the theory of Judicial Minimalism as inspired by Sunstein. Its focus will demonstrate how a minimalist court tends to decide in a shallow and narrow way, whereas maximalist courts tend to rule in a deep and width way. The advantages of Minimalism will also be achieved in light of deliberative democracy. Continuing, in the second chapter, the institute of the Appeal do Congress will be placed under a theoretical scrutiny. It will be analyzed its origin, its structure, its dynamics and the cases in which it is applied by the German Federal Constitutional Court. In the third and last chapter, the hypothesis itself will be reached, that is, the verification of the possibility of using the institute of Appeal to Congress to transform the STF into a more minimalist court. To this end, it will be verified whether there are means, already available, that can move the Supreme Court away from maximalism, as well as whether such means are fully effective or whether the Appeal to Congress has some space to fulfill an inducing role of minimalism in the STF. The method of approach used was inductive and the method of procedure adopted was monographic. The research techniques were bibliographical and documental.
