A subjetivação de características empreendedoras neoliberais por meio da educação jurídica: uma análise das Resoluções CNE/CES N. 9/2004 e N. 5/2018

Abstract

A presente dissertação de mestrado objetiva demonstrar que, em comparação a Resolução CNE/CES 9/2004, a Resolução CNE/CES 5/2018 intensifica a subjetivação de características empreendedoras neoliberais nos bacharéis em Direito. A racionalidade neoliberal, que preza pela livre concorrência, bem como se utiliza de critérios de mercado para a análise das relações sociais, se porta de forma hostil à concepção de sujeito de direitos, na medida em que a garantia de direitos é avaliada sob a perspectiva de custos, que prejudicaria a livre concorrência, bem como o desenvolvimento do mercado. O neoliberalismo ultrapassou os limites do domínio econômico e do domínio de mercado, influenciando diversos segmentos da vida em sociedade, inclusive instituições públicas e privadas, desencadeando reflexos no processo de constituição da subjetividade, despertando a figura do sujeito empreendedor. O sujeito empreendedor, sujeito neoliberal por excelência, despreza o convívio em sociedade e enaltece a individualidade, pois entende que está em permanente concorrência com seus pares, ao passo em que orientado pela racionalidade de mercado. Assim sendo, a este juízo, a garantia de direitos por parte do Estado aos cidadãos deve ser desprezada, eis que fere a livre concorrência. Entretanto a educação jurídica nacional, na sua atual concepção, parte da premissa que os cidadãos são sujeitos de direitos. Ocorre que atualmente é possível constatar a progressiva inserção de elementos e características empreendedoras neoliberais na educação jurídica, inclusive em harmonia à diretivas de organismos internacionais. Neste sentido, vale ressaltar que embora a Resolução CNE/CES 9/2004 já apresentasse compromissos com a inovação e com mercado de trabalho jurídico, características estas que podem ser associadas ao empreendedorismo neoliberal, o compromisso com o gerencialismo e com a internacionalização, aliados à manutenção da inovação e à intensificação em relação ao compromisso com o mercado de trabalho jurídico, evidenciam que a Resolução CNE/CES 5/2018 não só contempla, mas acentua a influência do empreendedorismo neoliberal na educação jurídica, contexto que se relaciona ao processo de subjetivação dos bacharéis em Direito, de forma consciente ou não, demonstrando uma nova feição da relação entre educação jurídica e capitalismo. A metodologia adotada para o desenvolvimento da presente pesquisa é a revisão bibliográfica, aliada a pesquisa documental, de pareceres, resoluções e disposições legais, principalmente relacionados ao Conselho Nacional da Educação, por meio de sua Câmara de Educação Superior ? CNE/CES.

Abstract: This master's dissertation aims to demonstrate that, in comparison to Resolution CNE/CES 9/2004, Resolution CNE/CES 5/2018 intensifies the subjectivation of neoliberal entrepreneurial characteristics in law graduates. Neoliberal rationality, which values free competition, as well as uses market criteria for the analysis of social relations, behaves in a hostile way to the conception of the subject of rights, insofar as the guarantee of rights is evaluated from the perspective of costs, which would harm free competition as well as market development. Neoliberalism surpassed the limits of the economic domain and the market domain, influencing different segments of life in society, including public and private institutions, triggering reflections in the process of constituting subjectivity, awakening the figure of the entrepreneurial subject. The enterprising subject, neoliberal subject par excellence, despises living in society and praises individuality, as he understands that he is in permanent competition with his peers, while guided by market rationality. Therefore, in this judgment, the guarantee of rights by the State to citizens must be disregarded, since it harms free competition. However, national legal education, in its current conception, is based on the premise that citizens are subjects of rights. It so happens that it is currently possible to observe the progressive insertion of neoliberal entrepreneurial elements and characteristics in legal education, including in harmony with the directives of international organizations. In this sense, it is worth mentioning that although Resolution CNE/CES 9/2004 already presented commitments with innovation and with the legal labor market, characteristics that can be associated with neoliberal entrepreneurship, the commitment with managerialism and with internationalization, allied to the maintenance of innovation and the intensification in relation to the commitment to the legal labor market, show that Resolution CNE/CES 5/2018 not only contemplates, but accentuates the influence of neoliberal entrepreneurship in legal education, a context that is related to the process of subjectivation of law graduates, consciously or not, demonstrating a new feature of the relationship between legal education and capitalism. The methodology adopted for the development of this research is a bibliographical review, combined with documental research, of opinions, resolutions and legal provisions, mainly related to the National Council of Education, through its Higher Education Chamber - CNE/CES.
