A responsabilidade civil da Airbnb por acidentes de consumo em decorrência de danos causados ao hóspede

Abstract

A presente dissertação de mestrado teve por objetivo averiguar a natureza jurídica da plataforma digital de compartilhamento Airbnb em sua relação com o consumidor-usuário (anfitrião). Partindo do pressuposto de que o consumo, como símbolo, reflete os valores sociais, o primeiro capítulo dedicou-se ao estudo da sociedade de consumo, contexto em que encontra-se inserido o consumo compartilhado, que foi objeto de estudo, em seguida, no primeiro capítulo. O segundo capítulo teve por escopo a análise da responsabilidade civil no ordenamento jurídico brasileiro, com ênfase no microssistema de responsabilidade civil de consumo. O objetivo foi perquirir quais os fundamentos elegidos pelo legislador para configuração do dever de indenizar, com intuito, a partir da evolução do instituto, melhor compreender o que pode ser compreendido por fato do serviço. O terceiro capítulo, por fim, analisou aspectos do comércio eletrônico e da importância do princípio da confiança para essa modalidade de consumo. Ainda, analisou as alterações do Código de Defesa do Consumidor no que concerne ao comércio eletrônico, tanto através do Dec. 7.862/2013 como as propostas de atualização do PLS 281/2012. Por fim, foi objeto de estudo no terceiro capítulo a plataforma Airbnb é realizada uma análise jurisprudencial dos julgados proferidos pelos Tribunais de Justiça da região sul do Brasil, com intuito de verificar de que modo os magistrados sulistas têm enfado a matéria relativa à natureza jurídica da Airbnb, bem como acerca do fato do serviço. Concluiu-se que os magistrados têm compreendido a Airbnb como integrante da cadeia de fornecimento, de modo a responsabilizá-la por acidentes de consumo sofridos por hóspedes nos termos do art. 3º, § 2º da Lei 8.078/90, bem como que o fato do serviço tem abrangido a tutela da confiança, da segurança e do direito à informação de que é titular o consumidor.

Abstract: The present master's dissertation aimed to investigate the legal nature of the digital sharing platform Airbnb in its relationship with the consumer-user (host). Assuming that consumption, as a symbol, reflects social values, the first chapter was dedicated to the study of the consumer society, a context in which shared consumption is inserted, which was the object of study, then, in the first chapter. The second chapter aimed to analyze civil liability in the Brazilian legal system, with emphasis on the microsystem of consumer civil liability. The objective was to investigate the grounds chosen by the legislator to configure the duty to indemnify, in order, from the evolution of the institute, to better understand what can be understood by the fact of the service. Finally, the third chapter analyzed aspects of electronic commerce and the importance of the principle of trust for this type of consumption. It also analyzed the changes to the Consumer Defense Code regarding electronic commerce, both through Dec. 7.862/2013 as proposed to update PLS 281/2012. Finally, in the third chapter, the Airbnb platform was studied and a jurisprudential analysis of the judgments handed down by the Courts of Justice of the southern region of Brazil was carried out, in order to verify how southern magistrates have been bored with the matter related to the legal nature of the Airbnb as well as about the fact of the service. It was concluded that the magistrates have understood Airbnb as a member of the supply chain, in order to hold it responsible for consumer accidents suffered by guests under the terms of art. 3, § 2 of Law 8.078/90, as well as the fact that the service has covered the protection of trust, security and the right to information held by the consumer.
