Proposta metodológica de análise e reestruturação do sistema judicial brasileiro a partir da visão sistêmica de Maturana e Varela

Abstract

O presente trabalho pretende fazer uma análise do sistema judicial brasileiro a partir do pensamento sistêmico de Maturana e Varela e ainda fazer uma proposta metodológica de sua reestruturação. Para tanto, utiliza-se dos conceitos operacionais da biologia da cognição como organização, estrutura, acomplamento estrutural e autopoeise, aplicando- os ao sistema judicial brasileiro. Observa as perturbações sofridas pelo sistema, tanto externas, quanto internas, e como ocorre o processo de adaptação através do acoplamento estrutural, resultando na dinâmica reestruturação do Judiciário. Por fim, com base nas observações realizadas e na proposta do pensamento sistêmico, propõe ações que possam desencadear ações efetivas na reestruturação do Judiciário brasileiro.

Abstract : The research intends to make an analysis of the Brazilian judicial system from the systemic thinking of Maturana and Varela and also make a methodological proposal of its restructuring. For this, the operational concepts of the biology of cognition are used as organization, structure, structural coupling and autopoeise, applying them to the Brazilian judicial system. It observes the disturbances suffered by the system, external and internal, and how the process of adaptation through the structural coupling takes place, resulting in the dynamic restructuring of the Judiciary. Finally, based on the observations made and the proposal of systemic thinking, it proposes actions that can trigger effective actions in the restructuring of the Brazilian Judiciary.
