O Mercosul e livre circulação de pessoas: um estudo sobre a migração mercosulina como constitutiva da integração regional

Abstract

A presente tese tem como objetivo geral investigar se o fenômeno da migração no Cone Sul atravessa o MERCOSUL, se colocando como um objeto de pesquisa propulsor e ontologicamente anterior à integração regional, assim como o comércio entre os países do bloco. Com isso, busca também reposicionar o tema da migração intrarregional no MERCOSUL nos estudos sobre a bloco do Cone Sul, conferindo centralidade à questão. A hipótese da presente Tese é a de que as conquistas regulatórias sobre o tema da migração mercosulina, desde a criação do MERCOSUL, são uma continuidade do processo de migração que já estava em curso e das tentativas legais que os governos lançavam mão para lidar com o fenômeno. A Tese está dividida em três partes. Na primeira o MERCOSUL, suas crises e abordagens acadêmicas são discutidas criticamente, com o intuito de preparar espaço para a centralidade da migração como tema e fenômeno resiliente na região e, portanto, no bloco. Na segunda parte é realizado um apontamento histórico da migração internacional na América do Sul, com foco nos países do Cone Sul, a partir da década de 1950 até a década de 1980 e uma discussão do MERCOSUL SOCIAL. Em seguida, por fim, é apresentado os avanços na legislação migratória do MERCOSUL, com enfoque no Acordo de Residência e evidenciando como a agenda da migração perpassa o bloco, na prática e no direito da integração, tendo como base um estudo de caso da migração de mercosulinos para Florianópolis e região.

Abstract: The present thesis has as general objective to investigate whether the phenomenon of migration in the Southern Cone crosses MERCOSUR, placing itself as a propelling research object and ontologically prior to regional integration, as well as trade between the countries of the bloc. With this, it also seeks to reposition the issue of intraregional migration in MERCOSUR in studies on the Southern Cone bloc, giving centrality to the issue. The hypothesis of this thesis is that the regulatory achievements on the issue of Mercosur migration, since the creation of MERCOSUR, are a continuation of the migration process that was already underway and of the legal attempts that the governments made to deal with the phenomenon. The thesis is divided into three parts. In the first, MERCOSUR, its crises and academic approaches are critically discussed, with the aim of preparing space for the centrality of migration as a resilient theme and phenomenon in the region and, therefore, in the bloc. In the second part, a historical note of international migration in South America is made, focusing on the Southern Cone countries, from the 1950s to the 1980s, and a discussion of SOCIAL MERCOSUR. Then, finally, advances in MERCOSUR migration legislation are presented, focusing on the Residency Agreement and showing how the migration agenda permeates the bloc, in practice and in the law of integration, based on a case study of migration from mercosulians to Florianópolis and region.
