Ela (não) é quase da família: uma perspectiva interdisciplinar sobre a relação empregada doméstica e empregador a partir da Lei Complementar 150/2015

Abstract

O objetivo deste trabalho é compreender a relação trabalhista entre empregada doméstica e empregador após a LC 150/2015, vista sob uma perspectiva interdisciplinar entre o Direito e a Sociologia, apontando as mudanças legislativas e quais as características históricas da relação, forjada na escravidão, ainda permanecem. Para tanto, o método utilizado envolve pesquisa bibliográfica e documental. É mostrada a origem da relação de trabalho doméstico, no Brasil Colônia, em que a relação era de senhor e trabalhadora escravizada, e que, mesmo após a abolição, permaneceu com várias continuidades. Dessa forma, a permanência do perfil do trabalho doméstico remunerado no Brasil segue sendo bastante identificável: mulher, negra e pobre. Apesar de empregado doméstico ser um conceito que abrange muitos tipos de profissionais, homens e mulheres, escolhemos tratar das empregadas mulheres. Nesse sentido, a Sociologia e os conceitos de classe, raça e gênero são fundamentais para ampliar a compreensão da relação de trabalho em questão. Entre os resultados, percebe-se o reflexo da origem do trabalho doméstico na escravidão sobre a aprovação tardia de lei específica que regula a relação de trabalho. Aponta-se a ambiguidade afetiva existente nessa relação, com retóricas de afeto e laços familiares que criam um cenário turvo, atrapalhando a solidificação dos direitos das domésticas e ofusca a verdadeira relação entre empregador e empregada. Outro importante apontamento refere-se aos direitos mais enxutos das empregadas domésticas ao comparar a LC 150/2015 com a CLT e os direitos dos demais trabalhadores. Destaca-se a própria marginalização do trabalho doméstico remunerado na Constituição de 1988.

The objective of this paper is to understand the labor relationship between domestic servant and employer after LC 150/2015, seen from an interdisciplinary perspective between Law and Sociology, pointing out the legislative changes and which historical characteristics of the relationship, forged in slavery, still remain. To this end, the method used involves bibliographic and documentary research. The origin of the domestic work relationship is shown, in Colonial Brazil, where the relationship was that of master and slave worker, and that, even after abolition, remained with various continuities. In this way, the profile of paid domestic work in Brazil is still quite identifiable: woman, black, and poor. Although domestic help is a concept that encompasses many types of professionals, men and women, we have chosen to deal with women domestic workers. In this sense, sociology and the concepts of class, race, and gender are fundamental to broaden the understanding of the labor relationship in question. Among the results, one can see the reflection of the origin of domestic work in slavery on the llate approval of a specific law regulating the work relationship. The affective ambiguity of the relationship is pointed out, with rhetoric of affection and family ties that create a cloudy scenario, hindering the solidification of the rights of domestic workers and obscuring the true relationship between employer and employee. Another important point refers to the leaner rights of domestic workers when comparing LC 150/2015 with the CLT and the rights of other workers. It also highlights the very marginalization of paid domestic work in the 1988 Constitution.
