Formalidades no direito de autor: da proibição internacional à sua reinserção na sociedade informacional

Abstract

O objetivo da presente pesquisa consiste em responder à seguinte questão: é justificável, pelo prisma da sociedade informacional, a reinserção de formalidades no Direito de Autor? Posta tal problemática, partiu-se da hipótese de que tal se mostra justificável diante da perda gradual de sentido da sua proibição internacional, medida que contribuiu para distanciar dito ramo do Direito do interesse público a ele imanente. Para avançar na exploração do objetivo proposto, adotou-se como método de procedimento o monográfico, como método de abordagem o dedutivo e como técnicas de pesquisa a bibliográfica e a documental. Na primeira parte do estudo, buscou-se efetuar uma análise conceitual, teórica e histórica do Direito de Autor a partir do paradigma sistemas condicionados vs sistemas incondicionados de proteção, com o fim de contextualizar o tema proposto e identificar a suposta existência de fundamentação suficiente para sustentar a permanência da regra proibitiva nos moldes introjetados pela Revisão de 1908 da Convenção de Berna. Neste ínterim, conceituou-se formalidades como sendo os requisitos formais que a lei estabelece aos autores e titulares derivados de direitos com o objetivo de garantir ou manter a incidência legal, gerar evidências, e/ou, ainda, fazer cumprir direitos perante os tribunais. Na sequência, enfocou-se em atualizar os debates relacionados ao Direito de Autor e os possíveis caminhos para sua reforma, a partir das variáveis que compõem a chamada sociedade informacional, procurando demonstrar a viabilidade de se rediscutir as formalidades por este novo prisma. Ao final, enfocou-se na abordagem dos pilares que fundamentam e estimulam uma rediscussão do tema proposto, baseando-se no potencial que o instituto em questão possui de garantir a livre expressão e o livre fluxo de informações, preservar e enriquecer o domínio público e reduzir custos de transação levando em conta a evolução tecnológica em curso. Diante de todos os pormenores sob os quais se debruçou, consequentemente, concluiu-se ser justificável a reinserção das formalidades no Direito de Autor, tendo em vista o potencial que possuem de atender ao interesse público entrelaçado ao ramo em questão, precipuamente quando projetadas visando preservar a posição dos titulares originários de direitos. Isto poderá se dar, por exemplo, tanto através da criação de mecanismos que não levem à perda imediata de direitos aos citados ? mas que os conduzam a cumprir requisitos obrigatórios no curso do tempo ? quanto mediante a construção de uma estrutura rigorosa de exigências de caráter informacional direcionadas aos demais players do mercado cultural.

Abstract: The purpose of this research is to answer the following question: is it justifiable, from the perspective of the information society, the reinsertion of formalities in Copyright Law? Given this problem, we started from the hypothesis that this is justifiable given the gradual loss of meaning of the international prohibition in question, a measure that contributed to distance this branch of Law from the public interest immanent to it. To advance in the exploitation of the proposed objective, the monographic method of procedure, the deductive method of approach, and the bibliographic and documentary research techniques was adopted. In the first part of the study, we sought to carry out a conceptual, theoretical and historical analysis of Copyright Law from the paradigm of conditioned vs unconditioned protection systems, in order to contextualize the proposed theme and identify the supposed existence of sufficient grounds for sustain the permanence of the prohibitive rule as introjected by the 1908 Revision of the Berne Convention. In this point, we conceptualized formalities as the formal requirements that the law establishes for authors and holders of rights in order to guarantee or maintain legal incidence, generate evidence, and/or even enforce rights before the courts. After this, we focused on updating the debates related to Copyright Law and the possible paths for its reform, based on the paradigm and variables that make up the so-called information society, seeking to demonstrate the feasibility of re-discussing the formalities through this new perspective. In the end, we focused on approaching the pillars that underlie and encourage a re-discussion of the proposed theme, based on the potential that the institute in question has to guarantee the free expression and free flow of information, to preserve and enrich the public domain and to reduce transaction costs taking into account the ongoing technological evolution. In view of all the details under which it was looked over, therefore, we concluded that the reinsertion of formalities in Copyright Law is justifiable, given the potential they have to serve the public interest intertwined with the field in question, especially when designed to preserve the position of original rights holders. This could happen, for example, both through the creation of mechanisms that do not lead to the immediate loss of rights to the aforementioned ? but that lead them to comply with mandatory requirements over time ? and through the construction of a rigorous structure of informational requirements directed to the other players in the cultural market.
