Democracia e representação política no pós-autoritarismo italiano: a noção de ?partidos políticos? de Costantino Mortati nos embates da experiência constituinte de 1948

Abstract

Através da presente pesquisa, objetiva-se analisar a concepção de democracia e representação política no pensamento jurídico de Costantino Mortati através do papel que sua teoria constitucional atribui aos partidos políticos. Para isso se percorrerá um caminho metodológico que inicia-se com a revisão das principais construções teóricas de seu pensamento jurídico, para delinear as categorias que pautam sua análise sobre a representação política. Em seguida, será realizado um apanhado sobre a circulação do conceito de representação política no século XX tendo como referência o conceito de Crise do Estado Moderno e a concepção de partido político que inaugura-se nesse período, através da noção de parte totale. Finalmente, se analisará a noção de partidos políticos em Mortati, tanto na contextualização do partido único como sua abordagem sobre o pluripartidarismo no período de reconstrução democrática pósautoritário italiano. Assim, será possível interpretar a luz dos eventos históricos e do método de Mortati as propostas apresentadas em sede de Assembleia Constituinte que refletem a conexão entre a regulamentação dos partidos políticos e as formas alternativas de representação política no poder legislativo e a qualidade da democracia pretendida em um Estado Democrático.

Abstract: Through this research, the objective is to analyze the concept of democracy and political representation in Costantino Mortati's legal thought through the role that his constitutional theory attributes to political parties. For this purpose, the following methodological path will be taken: first, we?ll review the main theoretical constructions of his legal thinking, to outline the categories that guide his analysis of political representation. Then, we?ll proceed with an overview of the circulation of the concept of political representation?s circulation in the twentieth century, according to the idea there?s a Crisis of the Modern State, so that we can conceive how the concept of political party is inaugurated by that period, through the notion of parte totale. Finally, the notion of political parties in Mortati will be analyzed, both in the context of the single party as its approach to pluripartisanship in the period of Italian post-authoritarian democratic reconstruction. Thus, it will be possible to interpret in the light of historical events and Mortati's method the proposals presented at the Constituent Assembly that reflect the connection between the regulation of political parties and the alternative forms of political representation in the legislative power and the quality of democracy intended in a Democratic State.
