Neoliberalismo, direito e mal-estar

Abstract

Esta pesquisa parte da hipótese de que o discurso neoliberal causa mal-estar subjetivo e sofrimento psíquico. A racionalidade contemporânea é perpassada pelo neoliberalismo, uma teoria que nasce no campo da economia, mas que se alastra para outras esferas da vida humana, como o direito, a política e a subjetividade. A fim de compreender em que consiste a racionalidade neoliberal e como direito e os modos de subjetivação passam a organizar-se e operar, investigou-se, primeiramente, o nascimento do liberalismo político e econômico juntamente ao Estado moderno. No liberalismo, o mercado serve como instância de verificação da atuação estatal e funciona de acordo com leis naturais; devendo, portanto, ser deixado livre. A passagem da ideologia liberal para a ideologia neoliberal implica modos distintos de compreender a atuação do Estado, que deve, nesse segundo caso, interferir na economia de modo a promover a concorrência entre os sujeitos econômicos ? as empresas. Ocorre que a lógica concorrencial passa a reinar sobre toda a sociedade; as instituições públicas, privadas e os próprios indivíduos passam a organizar-se na forma de empresa. Nesse meio, o direito positivo, de raízes liberais, entra em crise, eis que se vê entre duas incumbências conflitantes: afiançar o mercado concorrencial e garantir os direitos fundamentais aos cidadãos; instaura-se, pois, um estado de exceção permanente. Enquanto isso, os indivíduos, cercados por diversos imperativos de ferro, são obrigados a adaptarem-se ao mundo contemporâneo, que cada vez lhes exige mais física e subjetivamente. A equação é vertiginosa, o discurso neoliberal está fadado a devorar tudo, falta saber se algo do sujeito e do seu desejo ainda vai restar.<br>

Abstract: This research starts from the hypothesis that the neoliberal discourse causes malaise and psychological suffering. The contemporary rationality is permeated by neoliberalism, a theory which is born in the field of economics, but spreads to other spheres of human life, such as law, politics and subjectivity. In order to comprehend what the neoliberal rationality consists of and how law and subjectivation modes start to organize themselves and operate, at first, the birth of political and economic liberalism along with the modern State was investigated. During liberalism, the market serves as an instance of verification of the state actuation and works accord to natural laws; market should be, therefore, left free. The transition from the liberal ideology to the neoliberal ideology implies different ways of comprehending the State?s performance, which must, on this second case, interfere on economy so that it promotes concurrence between economic subjects ? the companies. However, the competition logic starts to reign on the whole society; public and private institutions and the individuals themselves are organized as a company. In this medium, positive law, with liberal roots, enters into crisis, behold between two conflicting incumbencies: securing the competitive market and guaranteeing fundamental rights to citizens; thus, a permanent state of exception is established. Meanwhile, individuals, surrounded by various imperatives of iron, are forced to adapt to the contemporary world, which increasingly demands more physically and subjectively. The equation is dizzying, the neoliberal discourse is doomed to devour everything, it remains to be seen whether something of the subject and his desire will still remain
