O contraditório participativo na resolução das demandas repetitivas

Abstract

A partir da nova sistemática, estabelecida pelo Código de Processo Civil de 2015, a respeito dos precedentes, e mais especificamente a resolução de demandas repetitivas, que compreende o novel Incidente de Resolução de Demandas Repetitivas e os Recursos, especiais e extraordinários, repetitivos, observa-se que é por meio de uma decisão paradigma que as causas repetitivas serão resolvidas, com o objetivo de garantir a igualdade e a segurança jurídica. Diante disso, a preocupação do presente estudo é observar como se manifesta o princípio do contraditório na criação dessa decisão paradigmática que resolve as causas repetitivas, a partir de um modelo cooperativo de Processo Civil. Isso implica em compreender o papel do amicus curiae, além de como são realizadas as audiências públicas, e qual o limite da requisição de informações pelo relator, bem como os limites de manifestações de processos sobrestados e representativos.

Abstract : Based on the new system, established by the Code of Civil Procedure of 2015, regarding the precedents, and more specifically the resolution of repetitive demands, which includes the novel Incident of Resolution of Repetitive Demands and the repetitive appeal, special and extraordinary, observes is that it is through a paradigm decision that the repetitive causes will be solved, thus aiming at equality and legal certainty. Therefore, the concern of the present study is to observe how the contradictory principle is manifested in the creation of this paradigmatic decision that solves repetitive causes, based on a cooperative model of civil process. This implies understanding the role of the amicus curiae, as well as how the public happen, and the limits of the request for information by the rapporteur, as well as the limits of manifestations of processes that are over-represented and representative.
