Corpus iuris civilis: uma tradução do Livro IV do Digesto hermeneuticamente fundamentada

Abstract

A presente tese de doutorado pretendeu realizar uma tradução do Livro IV do Digesto de Justiniano (Corpus Iuris Civilis) com fundamento na tradição hermenêutica. Para tanto, foi reconstruída a tradição hermenêutica a partir da teoria da recepção dos clássicos, com vistas a uma discussão dos fatores que estão em jogo ao se realizar a tradução de um texto clássico pertencente a uma era da história da humanidade considerada extinta em muitos aspectos. Corolário da hermenêutica é a centralidade do contexto para a melhor compreensão do discurso alheio. Portanto, estudou-se o contexto do direito romano no tempo e no espaço da sua vigência, a produção jurídica romana em suas fases políticas e por obra dos seus juristas. Expendeu-se a formação dos reinos germânicos na sequência da queda do Império Romano do Ocidente, a relativa manutenção do direito romano e a influência do direito germânico na formação do direito europeu posterior. Discutiu-se a composição do Corpus Iuris Civilis, a sua redescoberta no século XII na Itália e a sua influência no desenvolvimento do jus commune. Finalmente, ofereceram-se, juntamente com a tradução do livro escolhido, comentários de expressões e contextos selecionados.

Abstract : This thesis aimed to carry out a translation of Book IV of the Digest of Justinian (Corpus Iuris Civilis) based on the hermeneutic tradition. To do so, the reconstruction of hermeneutics was produced from the Classical Reception theory perspective, seeking to offer a discussion about the factors that are at stake in the translation of a classic text belonging to an era in the history of humanity considered extinct in several aspects. The corollary of hermeneutics is the centrality of the context for a better understanding of the discourse of others. Thus, the context of Roman law was studied in the time and space of its validity, as well as the Roman juridical production in its political phases and by the work of its jurists. We explored the formation of the Germanic kingdoms followed the fall of the Roman Empire of the West, the relative maintenance of Roman law, and the influence of German law in the formation of later European law. The composition of Corpus Iuris Civilis was discussed, its rediscovery in the twelfth century in Italy and its influence on the development of jus commune. Finally, comments on selected expressions and contexts were offered along with the translation of the book chosen for translation.
