Crianças refugiadas: um olhar para infância e seus direitos

Abstract

Esta dissertação tem como tema as crianças refugiadas. A mobilidade de grupos humanos em condições adversas e a necessidade de se refugiarem em países que permitam abrigo tem se constituído como um movimento recorrente na história da humanidade. Entretanto, a preocupação com a situação das crianças envolvidas na condição de refugiadas ainda é pouco investigada. Trata-se de uma pesquisa qualitativa a partir da análise documental como método de compreensão e produção do conhecimento científico acerca da possível infância vivida pelas crianças refugiadas e o direito à educação. A partir de referenciais teóricos da Sociologia da Infância e da perspectiva Histórico-cultural, o estudo tem como marco a Doutrina da Proteção Integral e a aplicabilidade do Direito da Criança e do Adolescente como afirmação do Direito Internacional dos Direitos Humanos. A pesquisa apresenta uma breve contextualização dos refugiados no âmbito internacional, regional e nacional, com especial destaque às crianças. O foco de análise centra-se na infância, problematizando-a a partir da investigação das condições de vida das crianças refugiadas e dos seus direitos, garantidos ou não, a partir da legislação internacional e nacional. Com esse objetivo em vista, estudou-se os principais instrumentos internacionais e regionais relativos aos refugiados e às crianças, como a Convenção Relativa ao Estatuto dos Refugiados de 1951 e seu respectivo Protocolo de 1967, a Declaração de Cartagena de 1984, a Convenção sobre os Direitos da Criança de 1989 e o Estatuto da Criança e Adolescente de 1990. Foram analisados os relatórios e programas referentes as crianças refugiadas elaborados pelo UNICEF e o ACNUR, bem como o uso de imagens desses indivíduos que circularam pelo mundo nos últimos anos. A escolha por fotografias possibilitou a ampliação do olhar para a compreensão das possíveis condições de infância vividas pelas crianças refugiadas em diferentes regiões do mundo. Verificou-se nesse trabalho que a infância não é uma experiência única, mas que há diferenças e semelhanças entre cada uma delas em relação ao seu contexto sócio-histórico-cultural.

Abstract : This dissertation is about the refugee children. The mobility of human groups in adverse conditions and the need to take refuge in countries that offer shelter has become a recurrent movement in the human history. However, the concern about the situation of children involved in refugee status has been insufficiently studied. It is a qualitative research based on documentary analysis as a method of understanding and producing scientific knowledge on possible childhoods experienced by refugee children and the right to education. From theoretical frameworks of Sociology of Childhood and cultural-historical perspective, the study is based on the Doctrine of Integral Protection and applicability of the Law of the Child and Adolescent as an affirmation of International Human Rights. It brings a brief contextualization of human rights and the concept of refugee s origin, with special emphasis on children. The core of the analysis focuses on childhood problematizing it from the investigation of the living conditions of the refugee children and their rights, guaranteed or not, based on international and national legislation. With this aim, the main international and regional instruments concerning refugees and children were studied, such as the 1951 Refugee Convention and its 1967 Protocol, the 1984 Cartagena Declaration on Refugee, the 1989 Convention on the Rights of the Child, and the 1990 Child and Adolescent Statute. Subsequently, the reports and programs on refugee children prepared by UNICEF and UNHCR will be analyzed, as well as the use of images of this people that circulated around the world in recent years. The choice of photographs allowed the widening of the look to understand the possible conditions of childhood lived by refugee children in different regions of the world. It was verified during this research that childhood is not a single experience, but there are diferences and similarities between each one of them according to their social, cultural and historical context.
