Abstract: A combinação de fatores econômicos, sociais e tecnológicos provocou a modificação das formas de organização empresarial e de pactuação do trabalho, conferindo substrato fático para o legislador promover transformações no Direito do Trabalho, com destaque para a Lei n. 13.467/2017, que instituiu a categoria do empregado hipersuficiente e conferiu maior eficácia à autonomia privada nas relações laborais. Paralelamente, o movimento jurisprudencial capitaneado pelo Supremo Tribunal Federal, passou a admitir a validade de contratos de prestação de serviços, inclusive por meio da pejotização, reconfigurando a aplicação do princípio da primazia da realidade. O problema desta pesquisa consiste em identificar em que medida o Supremo Tribunal Federal relativiza a aplicação do princípio da primazia da realidade ao julgar reclamações que impugnam decisões da Justiça do Trabalho nas quais se reconhece a relação de emprego e se declara a invalidade de contratos de prestação de serviços autônomos, inclusive os celebrados por pessoa jurídica (pejotização). O exame preliminar das decisões permite sustentar, como hipótese, que a Corte não desconsidera a incidência da primazia da realidade, mas reconfigura a sua aplicação ao introduzir uma etapa prévia destinada à definição do regime jurídico aplicável ao caso concreto, que pode ser realizada tanto pelo legislador quanto pelo intérprete e aplicador do direito, na qual se procede à ponderação entre os princípios constitucionais do valor social do trabalho e da livre iniciativa. Uma vez definido o regime jurídico civil, torna-se indispensável a manifestação expressa sobre a validade ou invalidade do negócio jurídico celebrado entre as partes, mediante a aplicação da teoria das invalidades do Direito Civil, enquanto a primazia da realidade fica condicionada à prévia definição da incidência do regime jurídico trabalhista. A pesquisa insere-se na área de concentração Direito, Política e Sociedade, na linha Constitucionalismo, Democracia e Organização do Estado e no Projeto Coletivo Democracia Digital, Governança Pública, Inteligência Artificial e Inovação, ao examinar a atuação do Supremo Tribunal Federal diante de transformações econômicas, sociais e tecnológicas nas formas de organização produtiva e de pactuação do trabalho. Para verificar essa hipótese, a pesquisa adotou método misto, combinando revisão crítica da literatura especializada constitucional, cível e trabalhista com etapa empírica de caráter qualitativo e interpretativo. O objeto da etapa empírica foi constituído de decisões monocráticas proferidas pelo Supremo Tribunal Federal em sede de reclamação, no período compreendido entre 2022 e 2025, das quais 127 foram efetivamente analisadas. O corpus foi delimitado por critérios institucionais, temporais, processuais e temáticos, e a seleção final baseou-se na presença da expressão \"trabalhador hipersuficiente\", o que assegurou a rastreabilidade e a reprodutibilidade do processo de seleção. A partir da análise do padrão decisório de cada Ministro, foi possível reconstruir dogmaticamente a racionalidade decisória da Corte. Os resultados confirmam a hipótese: o Supremo Tribunal Federal não aplica a primazia da realidade de forma incondicional, mas a submete a uma etapa prévia de definição do regime jurídico aplicável, operada por meio da ponderação entre os princípios do valor social do trabalho e da livre iniciativa. A pesquisa apresenta duas contribuições científicas originais: a identificação e sistematização da racionalidade decisória implícita do Supremo Tribunal Federal, que não foi explicitada pela própria Corte nem objeto de estudos pela doutrina; e a demonstração da necessidade de aplicação da teoria das invalidades do Direito Civil e da boa-fé objetiva ao exame de validade dos contratos de prestação de serviços autônomos, quando definida a incidência do regime jurídico civil.Abstract: The combination of economic, social, and technological factors has driven changes in the forms of business organization and labor contracting, providing the factual basis for the legislature to promote transformations in Labor Law, particularly through Law No. 13,467/2017, which established the category of the hypersufficient employee and granted greater efficacy to private autonomy in labor relations. Concurrently, the jurisprudential movement led by the Federal Supreme Court began to uphold the validity of service contracts, including those executed through the use of legal entities by individual workers (a practice known as \"pejotização\"), thereby reconfiguring the application of the primacy of reality principle. The research problem consists of identifying the extent to which the Federal Supreme Court relativizes the application of the primacy of reality principle when adjudicating constitutional complaints (\"reclamações\") that challenge Labor Court decisions recognizing the existence of an employment relationship and declaring the invalidity of autonomous service contracts, including those entered into through legal entities. A preliminary examination of the decisions supports the hypothesis that the Court does not disregard the primacy of reality principle but reconfigures its application by introducing a prior stage aimed at determining the applicable legal regime for the specific case, which may be carried out by either the legislature or the interpreter and enforcer of the law, through a balancing of the constitutional principles of the social value of labor and free enterprise. Once the civil legal regime is established, an express ruling on the validity or invalidity of the legal transaction entered into by the parties becomes indispensable, through the application of the theory of invalidity under Civil Law, while the primacy of reality remains conditional upon the prior determination that the labor legal regime applies. The research is situated within the area of concentration Law, Politics and Society, the research line Constitutionalism, Democracy and State Organization, and the Collective Research Project Digital Democracy, Public Governance, Artificial Intelligence and Innovation, as it examine the role of the Federal Supreme Court?s in addressing economic, social and technological transformations in forms of productive organization and work contracting. To test this hypothesis, the research adopted a mixed-method approach, combining a critical review of specialized constitutional, civil, and labor law literature with a qualitative and interpretive empirical stage. The empirical stage examined individual decisions issued by the Federal Supreme Court in constitutional complaint proceedings filed between 2022 and 2025, of which 127 were effectively analyzed. The corpus was delimited by institutional, temporal, procedural, and thematic criteria, and the final selection was based on the presence of the expression \"hypersufficient worker,\" ensuring the traceability and reproducibility of the selection process. Through the analysis of each Justice's decisional pattern, it was possible to dogmatically reconstruct the Court's decisional rationale. The results confirm the hypothesis: the Federal Supreme Court does not apply the primacy of reality unconditionally but subjects it to a prior stage of determining the applicable legal regime, carried out through the balancing of the principles of the social value of labor and free enterprise. The research presents two original scientific contributions: the identification and systematization of the implicit decisional rationale of the Federal Supreme Court, which had not been made explicit by the Court itself nor addressed by legal scholarship; and the demonstration of the necessity of applying the theory of invalidity under Civil Law and the principle of objective good faith to the examination of the validity of autonomous service contracts when the civil legal regime is determined to apply.
