A presente pesquisa dispõe-se a analisar a ação rescisória fundada em erro de fato, por meio de seus pressupostos, elementos e o seu julgamento. Nesse contexto, a jurisprudência não é uníssona quanto ao julgamento da ação rescisória e, com isso, tem-se uma disparidade de decisões e entendimentos quanto ao processamento desta ação. À vista disso, o objetivo é demonstrar, de maneira crítica e coerente, a figura do erro de fato e o julgamento da ação rescisória, diferenciando o juízo de admissibilidade, o juízo rescindente e o juízo rescisório. Nesse cenário, o primeiro capítulo disserta sobre as noções gerais da ação rescisória, passando pela natureza jurídica, análise histórica e, ainda, a função social e constitucional desta ação. A seguir, diferencia-se nulidade de rescindibilidade e revisita-se a coisa julgada, seja ela formal ou material. Por fim, considerando o objeto da ação rescisória, elencam-se as decisões rescindíveis. O segundo capítulo trata dos pressupostos particulares da ação rescisória e as hipóteses de rescisão indicadas no art. 966 do Código de Processo Civil. Já o terceiro capítulo, de maneira lógica, discorre sobre o erro de fato e suas características, como natureza jurídica, diferenciação entre erro de fato e erro de direito e, por fim, os quatro elementos que caracterizam o erro de fato. O quarto capítulo dispõe sobre o julgamento da ação rescisória fundada em erro de fato desde o seu recebimento, pelo relator preparador, até a prolação de nova decisão, em juízo rescisório. O resultado desta pesquisa tem como intuito demonstrar a necessidade de padronização no julgamento da ação rescisória fundada em erro de fato (e que pode se aplicar às demais hipóteses de rescisão), com a efetiva divisão das três etapas: juízo de admissibilidade, juízo rescindente e juízo rescisório, a fim de se garantir maior efetividade no julgamento desta ação excepcional. A pesquisa se vale do método predominantemente indutivo, com base na análise de julgados representativos e na investigação documental, bibliográfica e normativa atinente ao tema. Além disso, foi desenvolvida no âmbito do Programa de Pós-Graduação em Direito da Universidade Federal de Santa Catarina e está inserida na Área de Concentração Direito, Política e Sociedade, integrada à linha de pesquisa Direito Privado, Processo e Sociedade de Informação, considerando a análise e interpretação da norma processual brasileira. Abstract: This research aims to analyze the action for relief from judgment (ação rescisória) based on a mistake of fact, through its prerequisites, elements, and adjudication. In this context, jurisprudence is not unanimous regarding the adjudication of the action for relief from judgment, resulting in a disparity of decisions and understandings regarding its processing. In view of this, the objective is to demonstrate, in a critical and coherent manner, the figure of the mistake of fact and the adjudication of the action for relief from judgment, differentiating the admissibility review (juízo de admissibilidade), the rescissory judgment (juízo rescindente), and the substitute judgment (juízo rescisório). In this scenario, the first chapter discusses the general concepts of the action for relief from judgment, examining its legal nature, historical analysis, and also its social and constitutional function. Next, it differentiates nullity from rescindability and revisits res judicata, both formal and material. Finally, considering the object of the action for relief from judgment, the rescindable decisions are listed. The second chapter deals with the specific prerequisites of the action for relief from judgment and the grounds for rescission indicated in Article 966 of the Brazilian Code of Civil Procedure. The third chapter logically discusses the mistake of fact and its characteristics, such as its legal nature, the distinction between a mistake of fact and a mistake of law, and, finally, the four elements that characterize a mistake of fact. The fourth chapter addresses the adjudication of the action for relief from judgment based on a mistake of fact, from its reception by the reporting judge (relator preparador) to the rendering of a new decision in the substitute judgment (juízo rescisório). The outcome of this research aims to demonstrate the need for standardization in the adjudication of the action for relief from judgment based on a mistake of fact (which can also apply to other grounds for rescission), with the effective division of the three stages: admissibility review, rescissory judgment, and substitute judgment, in order to ensure greater effectiveness in the adjudication of this exceptional lawsuit. The research predominantly utilizes the inductive method, based on the analysis of representative case law and on documentary, bibliographical, and normative investigation related to the theme. Furthermore, it was developed within the scope of the Graduate Program in Law at the Federal University of Santa Catarina and is part of the Concentration Area of Law, Politics, and Society, integrated into the research line of Private Law, Procedure, and Information Society, considering the analysis and interpretation of the Brazilian procedural rule. |
