A Carta Africana de Direitos e Bem-estar da Criança e a necropolítica: contribuições ao direito internacional a partir das epistemologias do sul

Abstract

Esta tese tem como objetivo trazer discussões acerca da proteção internacional regional da criança, com análise de tratados regionais de direitos humanos no Sistema Regional Africano de Direitos Humanos e das Epistemologias do Sul no âmbito do Direito Internacional. Realiza-se uma imersão nos processos de composição epistemológica sobre o sujeito e o conhecimento, bem como na emergência do Sul Global enquanto espaço de redimensionamentos e potencialidades epistemológicas. São postos em foco, ainda, os debates acerca da necropolítica, que estrutura as relações de poder no sistema-mundo, em especial nas periferias; essa perspectiva parte das contribuições de Achille Mbembe para a análise do biopoder e da biopolítica inerentes às dinâmicas sociais e políticas. Nesse cntexto, apresenta-se como problema de pesquisa: como estão dispostas categorias com marcadores do eurocentrismo e da necropolítica na concepção de garantias e de mecanismos do Direito Internacional na Carta Africana de Direitos e do Bem-estar da Criança e da Carta Africana dos Direitos Humanos e dos Povos? Como hipótese de pesquisa, sustenta-se que a Carta Africana de Direitos e do Bem-Estar da Criança detém e reproduz categorias com bases epistemológicas fundadas no eurocentrismo, com incidências de aspectos estruturados na necropolítica. Os mecanismos do Direito Internacional previstos na Carta de Banjul, que organiza o Sistema Africano de Direitos Humanos, bem como as categorias analisadas, necessitam ser pensados a partir das Epistemologias do Sul. A relevância desse estudo reside em seu caráter inédito e em sua contribuição à comunidade científica brasileira, constituindo elemento preponderante para uma tese de doutorado. Utiliza-se a análise de conteúdo, com o uso da ferramenta de classificação e rotulação Doccano, para o exame do tratado temático em tela, bem como da Carta Africana de Direitos Humanos e dos Povos (Carta de Banjul), a partir da escolha de indicadores que sustentam esta pesquisa de natureza empírica.

Abstract: This doctoral thesis aims to promote discussions on the regional international protection of children, through the analysis of regional human rights treaties within the African Regional Human Rights System and the Epistemologies of the South in the field of International Law. The research undertakes an immersion into the epistemological processes related to the construction of the subject and knowledge, as well as the emergence of the Global South as a space of epistemological reconfigurations and potentialities. The debates on necropolitics are also brought into focus, as they structure power relations within the world-system, particularly in peripheral contexts; this perspective is grounded in Achille Mbembe9s contributions to the analysis of biopower and biopolitics inherent to social and political dynamics. In this context, the research problem is formulated as follows: how are categories marked by eurocentrism and necropolitics configured in the conception of guarantees and mechanisms of International Law within the African Charter on the Rights and Welfare of the Child and the African Charter on Human and Peoples9 Rights? As a research hypothesis, it is argued that the African Charter on the Rights and Welfare of the Child incorporates and reproduces categories grounded in eurocentric epistemological foundations, with incidences of necropolitical structures. The mechanisms of International Law provided for in the Banjul Charter, which organizes the African Human Rights System, as well as the categories analyzed, require reinterpretation from the perspective of the Epistemologies of the South. The relevance of this study lies in its original contribution to the Brazilian academic community, constituting a significant element for a doctoral thesis. The research adopts content analysis as its methodological approach, using the Doccano classification and labeling tool to examine the thematic treaty under analysis, as well as the African Charter on Human and Peoples9 Rights (Banjul Charter), based on selected indicators that support this empirical research.
