Segurança alimentar e poluição marinha por resíduos plásticos no Direito Internacional Ambiental: construção de estratégias de regulação e controle para mitigar os efeitos desses detritos em peixes comercializados globalmente

Abstract

A presente tese de doutorado tem como objetivo geral analisar de que maneira a construção de estratégias de regulação e de controle pode mitigar os efeitos da poluição marinha por resíduos plásticos no contexto de segurança alimentar pelo consumo de peixes comercializados globalmente. A poluição marinha por detritos plásticos configura-se como um problema global, complexo e multifacetado, que exige a implementação de medidas estratégicas para combater as consequências desses materiais perigosos e potencialmente tóxicos. Diante disso, particular atenção, nesta pesquisa, recai sobre os efeitos dessa poluição em peixes que integram a cadeia alimentar dos seres humanos, comprometendo a saúde da biodiversidade marinha e a segurança alimentar dos indivíduos, ao redor do globo, que consomem esses animais. Em razão da importância do assunto, a comunidade internacional, através das Nações Unidas, tem se esforçado nos últimos anos para criar um tratado global, atualmente em fase final de negociação, que aborde todo o ciclo de vida dos plásticos (produção, fabricação, consumo e descarte). À vista disso, para alcançar o objetivo geral, o presente trabalho se estrutura em quatro objetivos específicos, distribuídos respectivamente nos capítulos que compõem a presente tese. O primeiro apresenta um estudo sobre o conceito de segurança alimentar no Direito Internacional de maneira ampla. Já o segundo descreve o problema da poluição marinha, especialmente por resíduos plásticos, bem como a sua regulamentação pelo direito internacional ambiental. Em continuidade, o terceiro visa identificar o atual estado do conhecimento sobre o impacto da poluição marinha por resíduos plásticos em peixes comercializados globalmente. Por fim, o quarto analisa a construção de estratégias de regulação e de controle com a finalidade de mitigar os efeitos da poluição marinha por detritos plásticos em peixes comercializados globalmente. No que diz respeito à metodologia, a realização da pesquisa se dá por meio do método de abordagem dedutivo, onde parte-se de condições gerais para particulares. Como métodos de procedimento, a pesquisa recorre às abordagens histórica e estatística, complementadas pelas técnicas de revisão de literatura narrativa e sistemática para coleta de dados e informações. Dada a complexidade do tema proposto na enseada ambiental, é importante frisar que esta pesquisa é de caráter interdisciplinar, em que pese a sua natureza seja predominantemente jurídica. Os resultados obtidos deste trabalho evidenciam a necessidade de construir estratégias de regulação e de controle para mitigar os efeitos da poluição marinha por resíduos plásticos no contexto proposto. Essa análise baseia-se a partir de uma abordagem integrativa entre a noção de segurança alimentar e sua multidimensionalidade e a poluição marinha no contexto por resíduos plásticos, especialmente diante da crescente normatização voltada à temática no âmbito do direito internacional ambiental. Finalmente, ressalta-se que esta tese é desenvolvida em momento internacional pertinente, qual seja, a Década do Oceano (2021-2030), período em que pesquisas científicas sobre o oceano recebem atenção especial em todo o mundo.

Abstract: This doctoral thesis aims to analyze how the development of regulation and control strategies can mitigate the effects of marine pollution from plastic waste in the context of food security through the consumption of fish commercialized globally. Marine pollution from plastic debris is a global, complex, and multifaceted problem. It requires the implementation of strategic measures to combat the consequences of these dangerous and potentially toxic materials, particularly in the marine environment. In light of this, particular attention on this research is given to the effects of this pollution on fish that are part of the human food chain, compromising the health of marine biodiversity in the affected environment and the very food security of humans globally who consume these animals. Due to the importance of the issue, the international community, through the United Nations, has made efforts in recent years to create a global treaty, currently in the final stages of negotiation, that addresses the entire life cycle of plastics (production, manufacturing, consumption, and disposal). Therefore, to achieve the general objective, this research is structured in four specific objectives, distributed throughout the chapters of this thesis. The first presents a broad study of the concept of food security in International Law. The second describes the problem of marine pollution, especially from plastic waste, as well as its regulation under International Environmental Law. The third aims to identify the current state of knowledge regarding the impact of marine pollution from plastic waste on globally traded fish. Finally, the fourth analyzes the development of regulatory and control strategies to mitigate the effects of marine pollution from plastic waste in the context of food security through the consumption of globally traded fish. Regarding methodology, this research uses a deductive approach, from general to specific conditions. As for the procedural methods, the research employs historical and statistical approaches, complemented by narrative and systematic literature review techniques for data and information collection. Given the complexity of the proposed environmental topic, it is important to highlight that this research is interdisciplinary, despite its predominantly legal nature. The results in this research demonstrate the necessity of creating regulation and control strategies to mitigate the effects of marine pollution from plastic waste in the proposed context, based on an integrative approach between the concept of food security with its multidimensionality and marine pollution in the scenario of plastic waste pollution?both from the perspective of International Environmental Law (including the latest proposal for the new International Treaty on the topic). Finally, this thesis is developed during a significant international period, namely, the Decade of the Ocean (2021-2030), a period in which scientific research on the ocean garners special attention worldwide.
