Constitucionalismo comunitário da alteridade: a experiência andina na perspectiva do pluralismo jurídico e da filosofia da libertação

Abstract

O trabalho de pesquisa aqui desenvolvido trata de investigar as possibilidades de construção de um pensamento constitucional crítico e autêntico para América Latina. Tal empreendimento teórico justifica-se em razão de que a trajetória constitucional vivida nesta região tem combinado práticas teóricas de reprodução mimética de discursos constitucionais oriundos de países centrais com inefetividade dos dispositivos que prescrevem direitos. Esses dois eventos se dão de forma associada, à medida que a orientação colonial faz com o Constitucionalismo se converta em um expediente simbólico, que não traduz formas autênticas de ação política, devido ao descolamento existente entre as instituições e as formas sociais, redundando em um desajuste democrático. A construção de uma proposta teórica autêntica, na qual seja considerado o modo de ser latino-americano é a via para construção de uma democracia constitucional profunda com a efetivação das garantias propostas. A composição de tal proposta se dá pela combinação de um elemento legal, o Constitucionalismo Pluralista Andino, composto das constituições da Bolívia e do Equador, somado a dois elementos teóricos a Filosofia da Libertação e o Pluralismo Jurídico. O elemento legal apresenta novos preceitos trazidos da experiência andina e aponta uma nova proposta jurídico-política com a adoção do Estado Plurinacional, da democracia comunitária e a positivação do Pluralismo Jurídico. Diante deste quadro surge a demanda por um pensamento constitucional que fundamente esta experiência e traga elementos para discussão não só nestes dois países, ao mesmo tempo em que são oferecidos elementos para a construção desta nova teoria. A proposta aqui desenvolvida nominada como Constitucionalismo Comunitário da Alteridade, tem por elementos a (1) tradução constitucional da sabedoria popular com uma (2) práxis alteritária que reinvente a percepção teórica. Combinada com esta visão teórica tem-se a construção política do (3) sujeito coletivo biocêntrico que traz para o cenário político a percepção de um novo sujeito histórico visto em uma perspectiva integrada à natureza, o qual desencadeia a (4) soberania comunitária, que garante o reconhecimento das formas de organização e regulação existentes fora do Estado, as quais passam a ter a sua potestade reconhecida ante a este. Desta forma, o presente trabalho desenvolve uma pesquisa de Teoria Constitucional a partir da política.

Abstract : This paper tries to look over the possibilities of constructing a critical and authentic constitutional thought to Latin America. Such theoretical construction is justified because the fact that the constitutional ¬path lived in this region has matched theoretical practices of mimetic reproduction of constitutional speeches that come from central countries with ineffectiveness of device that prescribe rights. These two events happen in a parallel way as the colonial orientation makes that the constitutionalism transforms in a symbolic expedient, that do not suit authentic forms of political action due to the separation that exists among the institutions and the social forms, turning into a democratic disagreement. The construction of an authentic theoretical proposal in which is considered the Latin American way of living is the way to the construction of a deep constitutional democracy with the effectiveness of the proposed guarantees. The composition of such proposal is given by the matching of a legal element, the Andean Pluralist Constitutionalism, made up of the Constitutions of Bolivia and Ecuador plus two more theoretical elements ? the Philosophy of Freedom and the Juridical Pluralism. The legal element presents new precepts brought from the Andean an experience and shows a new juridical-political proposal with the adoption of the Pluri-national State, the community democracy and the positivity of the Juridical Pluralism. Thus, there is a necessity of a constitutional thought that found this experience and bring elements to discuss not only in these two countries and, at the same time that elements to the construction of this new theory are offered. Our proposal is named Community Constitutionalism of alterity has 1) constitutional translation of the popular knowledge with a 2) alteritáry praxis that reinvent a theoretical perception. Along this theoretical view we have the political construction of (3) the bio-centric collective subject that brings to this scenery the perception of a new historical subject seen in a perspective linked to the nature that unchains the (4) community sovereignty, that guarantees the acknowledgement of the ways of organization and regulation that exist out of the State that then have their power recognized. Thus, this paper develops a research of Constitutional Theory built on politics.
