A aplicação de medidas atípicas em obrigações pecuniárias: artigo 139, IV, do CPC/2015

Abstract

O presente trabalho objetiva analisar a possibilidade de aplicação de medidas atípicas em obrigações pecuniárias, à luz dos princípios do ordenamento jurídico. As medidas de efetivação prevista no artigo 139, IV, do Código de Processo Civil colocaram a execução de obrigações pecuniária no mesmo patamar das outras obrigações. O dispositivo permite a aplicação de medidas indutivas, coercitivas, mandamentais, e sub-rogatórias, atípicas para dar efetividade à tutela jurisdicional, inclusive à tutela de prestações pecuniárias. Na vigência do CPC/1973 não era permitido o emprego de medidas atípicas para obrigações pecuniárias, mas com o advento do CPC/2015 essa limitação de medidas não existe mais. O artigo 139, IV, do CPC/2015 possibilita o emprego de medidas atípicas para o cumprimento de obrigações pecuniárias, e no presente trabalho será abordado como pode ser feita essa aplicação.

This paper aims to analyze the possibility of applying atypical measures in pecuniary obligations, in light of the principles of the legal system. The enforcement measures provided for in article 139, IV, of the Code of Civil Procedure placed pecuniary obligations at the same level as other obligations. The mechanism allows the application of inductive, coercive, mandatory, and subrogatory measures, atypical to give effect to judicial protection, including the protection of pecuniary benefits. Under CPC / 1973, atypical measures for pecuniary obligations were not allowed, with the advent of CPC / 2015 this limitation of measures no longer exists. Article 139, IV, of the CPC/2015 allows the use of atypical measures for the fulfillment of pecuniary obligations, and in the present work will be approached how this application can be made.
