Crise do positivismo jurídico?

Abstract

Esta monografia tem o objetivo de proporcionar uma reflexão sobre os impactos da nova configuração neoliberal de escala mundial sobre o positivismo jurídico. O crescimento econômico restringido ao âmbito meramente nacional é impensável diante deste novo cenário que se apresentou. Um novo eixo do mundo é nítido em meados do século XX: o mercado. Por consequência, o positivismo jurídico, como teoria do direito, passou a ser deslegitimado principalmente pelas teorias autodominadas pós-positivistas, pois os pressupostos como hierarquia normativa, poder constituinte e separação entre direito e moral se tornaram incompatíveis com as demandas do paradigma econômico neoliberal.

This paper aims to provide a reflection on the impact of the new neoliberal configuration worldwide on legal positivism. Economic growth restricted to purely domestic is unthinkable before this new scenario that presented itself. A new axis of the world is clear in the mid-twentieth century: the market. Consequently, the legal positivism as a theory of law, has become delegitimized mainly by post-positivist theories as the assumptions as normative hierarchy, constituent power and separation between law and morality have become incompatible with the demands of neoliberal economic paradigm.
