A representatividade política no contexto do Estado laico

Abstract

O escopo desta pesquisa está em verificar se, no interior do processo de modernização que originou o modelo de sociedade secularizada hoje existente, houve uma efetiva separação entre política e religião. Nesse sentido, o objetivo geral perseguido é investigar se a promessa estatal de laicidade é plenamente cumprida nas relações políticas cotidianas, considerando-se a possível intromissão de uma variedade de credos religiosos. O trabalho emprega o método dedutivo e a hipótese aqui defendida consiste na ideia de que um representante político não está constitucionalmente legitimado a exercer o seu mandato visando ao favorecimento de alguma religião, assim como não pode sustentar a sua argumentação em fundamentos de cunho religioso. No primeiro capítulo, a igualdade e a liberdade são abordadas como princípios inspiradores do regime democrático, definindo-se a liberdade religiosa e a laicidade estatal. No segundo capítulo, realiza-se uma abordagem histórica sobre o processo de secularização do aparato político e jurídico. No terceiro capítulo, são feitas reflexões de cunho sociológico a respeito das inovações promovidas pela secularização no Brasil e da inserção massiva de religiosos na esfera política. Enfim, o quarto capítulo lida com a questão da religião como forma de controle social e apresenta as conclusões relativas à hipótese sustentada, tratando da noção da representatividade política religiosa.

The scope of this research is to determine whether, within the modernization process that originated today's secularized society model, there was an effective dissolution between politics and religion. In this sense, the general objective pursued is to investigate if the State's promise of secularism is fully met in everyday political relations, considering the possible interference from a variety of religious beliefs. The work employs the deductive method, and the supported hypothesis is the idea that a political commissary is not constitutionally legitimized to use its mandate aiming at favoring any religion, as well as should not support their argument in fundamentals of religious nature. In the first chapter, equality and freedom are addressed as inspiring principles of the democratic regime, and religious freedom and state secularism are defined. In the second chapter, the process of secularization of the political and legal apparatus is addressed using a historical approach. In the third chapter, sociological reflections on the innovations promoted by secularization in Brazil and on the massive insertion of religious in the political sphere are pointed out. Finally, the fourth chapter deals with the issue of religion as a means of social control and presents the conclusions relating to the hypothesis, dealing with the notion of religious political representation.
