O Professor reflexivo e o professor de direito: uma pesquisa de caráter etnográfico nos cursos de Direito da Grande Florianópolis

Abstract

O tema da tese enquadra-se no campo da Educação no Direito. Ela investiga o professor de Direito da grande Florianópolis tendo como objetivo principal verificar, a partir da hipótese de que o professor de Direito não reflete sobre seu papel pedagógico, se os aspectos repetidos na literatura das últimas décadas acerca da docência jurídica se corroboram no grupo escolhido para a averiguação. Trata-se de pesquisa de campo de caráter etnográfico realizada durante o segundo semestre de 2009, durante o período letivo, em todas as faculdades particulares e na Universidade Federal localizadas na área geográfica denominada grande Florianópolis. O referencial teórico epistemológico utilizado associa autores da área de educação que estudam o professor reflexivo tais como John Dewey, Donald Schön, António Nóvoa, Isabel Alarcão, Paulo Freire e o conceito de falseabilidade apresentada por Karl Popper. Após os momentos metodológicos bibliográficos e de observação prévia, elaborou-se um questionário a partir dos aspectos mais destacados nas referências bibliográficas utilizadas. A posterior coleta de dados foi feita com a aplicação deste questionário aos professores ativos no período e com formação jurídica através de registro em diário de campo das observações feitas além de alguns depoimentos espontâneos ouvidos durante a realização da pesquisa tanto de professores universitários de outras áreas, quanto de pessoas ligadas à área acadêmica em geral. O objetivo foi ir a campo para verificar se as principais hipóteses levantadas na bibliografia do ensino jurídico nos últimos 30 anos se confirmariam ou não. Também foi possível coletar informações sobre a imagem do professor de Direito. Este trabalho trás o resultado desta investigação através de análise quantitativa e qualitativa das respostas ao questionário.

The theme of this thesis fits into the field of Education in Law and investigates the profile of the Law university teacher of the city of Florianópolis and its surroundings (known as grande Florianópolis = Florianopolis county) having as its main objective to verify based on the hypothesis that Law university teachers do not reflect upon their pedagogical role if the recurrent aspects which are mentioned in the literature of the latest decades about Law teaching can be corroborated in the group chosen for this investigation. This paper is based on field research carried out along the second semester of 2009, school year, in all private universities and the Federal State University which are located in the geographical are known as grande Florianópolis. The epistemological theoretical reference utilized associates authors from the educational area who study the reflective teacher such as John Dewey, Donald Schön, António Nóvoa, Isabel Alarcão, Paulo Freire, and the concept of falseability presented by Karl Popper. After the methodological moments of reading and previous observation, a questionnaire was designed to investigate aspects to do with teachers profile most mentioned by the different authors. After that, data collection was done by applying this questionnaire to all active university teachers in that term who had graduated in law through the register in a field diary of the observations done. It was also took into consideration spontaneous testimonies heard along the research made by university teachers from other areas of study and from people related to the academic studies in general. The aim was to go to the universities where Law is taught to check if the main hypothesis raised by the previously selected bibliography on Law teaching in the last 30 years would be confirmed or not. We could also collect information about the image of the Law university teacher. This work brings the result of this investigation through quantitative and qualitative analysis of the responses provided in the questionnaire.
