O direito fundamental de liberdade de religião ou crença é tema profícuo e tornou-se relevante para as pessoas encarceradas, sobretudo quando, em 10 de maio de 2021, o Conselho Nacional de Justiça (CNJ), ao tratar da remição de pena pela leitura na Resolução nº. 391 (Res. CNJ nº 391/2021), explicitou que os livros religiosos podem compor o acervo bibliotecário dos estabelecimentos penais no Brasil. Diante disso, questiona-se: tendo em vista o direito fundamental de liberdade de religião ou crença, é possível à pessoa apenada e reclusa em estabelecimento penal no Brasil escolher o livro a ser lido para validar o direito à remição de pena pela leitura conforme suas convicções? O presente estudo objetiva realizar uma reflexão teórico-jurídico-normativa acerca do direito de liberdade de religião ou crença, verificando se este é reconhecido no direito à remição de pena e se, quando implementado nos estabelecimentos penais, possibilita à pessoa reclusa escolher o título da obra a ser lida para remição da pena em consonância com sua autodeclaração de crença ou religião. A hipótese consiste na existência de níveis variados de compreensão acerca do direito de liberdade de religião ou crença no Estado brasileiro, limitando o direito da pessoa presa de escolher a obra destinada à remição de pena conforme sua crença ou religião, refletindo-se em garantia incompleta do direito subjetivo individual de liberdade de religião ou crença. Metodologicamente, a pesquisa desenvolveu-se por meio de revisão bibliográfica e documental, com análise qualitativa, abordagem dedutiva e estrutura monográfica organizada em capítulos, conforme os objetivos específicos propostos. No primeiro capítulo, buscou-se compreender o direito de liberdade de religião ou crença, reconhecido historicamente nos contextos internacional e nacional. No segundo capítulo, estudou-se o direito à remição de pena, especialmente a remição pela leitura reconhecida pelo Tema Repetitivo nº 1278 do STJ, bem como o reconhecimento normativo para que livros religiosos passassem a compor os acervos prisionais no Brasil, conforme a redação da Res. CNJ nº 391/2021. No terceiro capítulo, refletiu-se sobre as possibilidades de a pessoa reclusa em estabelecimento penal no Brasil escolher a obra integrante do acervo prisional conforme sua autodeclaração de crença, descrença ou fé religiosa para validar o direito à remição de pena pela leitura, uma vez que o direito fundamental de liberdade de religião ou crença também a contempla. Em algumas realidades observadas, de forma microscópica, revelou-se compreensão desigual na implementação do direito de remir a pena pela leitura, sobretudo quanto à leitura de livros religiosos escolhidos pela pessoa presa. Constatou-se ser possível a leitura de qualquer obra pertencente ao acervo prisional, inclusive à luz do direito de liberdade de religião ou crença. Contudo, mostrou-se unânime a compreensão de que tal leitura permanece desvinculada do direito à remição de pena, contrariando o arcabouço jurídico-normativo. Pelo exposto, conclui-se que acomodações necessárias precisam ser avaliadas e implementadas, equilibrando-se as ofertas de livros destinados à remição de pena, bem como promovendo-se a capacitação laica do efetivo, a fim de garantir o direito fundamental de escolha pautado nas diferentes crenças ou religiões. |

Abstract: The fundamental right to freedom of religion or belief is a fruitful topic and has become particularly relevant to incarcerated individuals, especially since, on May 10, 2021, the National Council of Justice (CNJ), in addressing sentence reduction through reading in Resolution nº. 391 (Res. CNJ nº. 391/2021), explicitly stated that religious books may be part of the library collection of penal establishments in Brazil. Given this, the question arises: considering the fundamental right to freedom of religion or belief, is it possible for a person sentenced and incarcerated in a penal establishment in Brazil to choose the book to be read to validate the right to sentence reduction through reading according to their convictions? This study aims to carry out a theoretical-legal-normative reflection on the right to freedom of religion or belief, verifying whether this is recognized in the right to sentence reduction and whether, when implemented in penal establishments, it allows the incarcerated person to choose the title of the work to be read for sentence reduction in accordance with their self-declaration of belief or religion. The hypothesis consists of the existence of varying levels of understanding regarding the right to freedom of religion or belief in the Brazilian State, limiting the right of the incarcerated person to choose the work intended for sentence reduction according to their belief or religion, reflecting an incomplete guarantee of the individual subjective right to freedom of religion or belief. Methodologically, the research was developed through bibliographic and documentary review, with qualitative analysis, a deductive approach, and a monographic structure organized into chapters, according to the specific objectives proposed. The first chapter sought to understand the right to freedom of religion or belief, historically recognized in international and national contexts. The second chapter studied the right to sentence reduction, especially sentence reduction through reading recognized by STJ Repetitive Theme nº. 1278, as well as the normative recognition for religious books to become part of prison collections in Brazil, according to the wording of CNJ Resolution nº. 391/2021. In the third chapter, reflections were maded on the possibilities for a person incarcerated in a penal institution in Brazil to choose a work from the prison collection according to their self-declaration of religious belief, disbelief, or faith to validate the right to sentence reduction through reading, since the fundamental right to freedom of religion or belief also contemplates it. In some realities observed, in a microscopic way, unequal understanding was revealed in the implementation of the right to sentence reduction through reading, especially regarding the reading of religious books chosen by the incarcerated person. It was found that it is possible to read any work belonging to the prison collection, including in light of the right to freedom of religion or belief. However, there was unanimous understanding that such reading remains disconnected from the right to sentence reduction, contradicting the legal-normative framework. Therefore, it is concluded that necessary accommodations need to be evaluated and implemented, balancing the supply of books intended for sentence reduction, as well as promoting secular training for staff, in order to guarantee the fundamental right to choose based on different beliefs or religions. |
