Gênero, direitos e políticas públicas: a configuração do sistema socioeducativo para adolescentes do sexo feminino em Santa Catarina

Abstract

A presente dissertação intitulada ?Gênero, Direitos e Políticas Públicas: a configuração do Sistema Socioeducativo para adolescentes do sexo feminino em Santa Catarina tem, por objetivo principal, analisar a configuração do sistema socioeducativo voltado à adolescentes do sexo feminino em cumprimento de medida socioeducativa de internação no estado de Santa Catarina, dos anos de 2023 a 2025, na perspectiva das questões de gênero e violação de direitos à luz do Estatuto da Criança e do Adolescente (ECA) e das diretrizes do SINASE. O interesse pela temática decorre das experiências da pesquisadora com o tema desde a graduação em Serviço Social, sistematizadas inicialmente no Trabalho de Conclusão de Curso, das quais emergiram novas inquietações, especialmente relacionadas às adolescentes autoras de ato infracional. Como procedimento metodológico, adotou-se a abordagem qualitativa, por meio de estudo documental. A coleta de dados foi realizada em duas dimensões: nacional e estadual, a partir dos dados do Levantamento do Sistema Nacional de Atendimento Socioeducativo dos anos de 2017, 2023 e 2024 e da pesquisa realizada pelo Conselho Nacional de Justiça em 2015; e, local, por meio da consulta aos processos judiciais em trâmite na Vara da Infância e da Juventude da Comarca de Florianópolis, referentes às adolescentes em cumprimento de medida socioeducativa de internação no Centro de Internação Feminino de Florianópolis, no período de 2023 a 2025. A partir desses materiais, realizou-se a análise dos dados com o objetivo de compreender as especificidades da execução da medida socioeducativa de internação para adolescentes do sexo feminino no contexto catarinense. Os resultados da pesquisa permitiram identificar que a presença de adolescentes do sexo feminino no sistema socioeducativo permanece marcada por processos de invisibilidade institucional e social. Embora os marcos legais fundamentados na Doutrina da Proteção Integral representem avanços normativos, sua efetivação ainda encontra limites diante das desigualdades estruturais atravessadas por relações de gênero, classe e raça.

Abstract: This dissertation, entitled ?Gender, Rights and Public Policies: the configuration of the Socio-Educational System for female adolescents in Santa Catarina?, aims to analyze the configuration of the socio-educational system directed at female adolescents serving custodial socio-educational measures in the state of Santa Catarina between 2023 and 2025, from the perspective of gender issues and rights violations, in light of the Brazilian Child and Adolescent Statute (ECA) and the guidelines of the National System of Socio-Educational Assistance (SINASE).The interest in this topic arises from the researcher?s engagement with the subject since her undergraduate studies in Social Work, initially systematized in her undergraduate thesis, from which new questions emerged, particularly concerning female adolescents who have committed juvenile offenses. As a methodological procedure, a qualitative approach was adopted through documentary research. Data collection was carried out at two levels: national and state. At the national level, data were drawn from the National Survey of the Socio-Educational Assistance System for the years 2017, 2023, and 2024, as well as from the research conducted by the National Council of Justice in 2015. At the local level, data were obtained through the consultation of judicial proceedings underway at the Childhood and Youth Court of the District of Florianópolis, referring to female adolescents serving custodial socio-educational measures at the Female Detention Center of Florianópolis between 2023 and 2025. Based on these materials, the data were analyzed in order to understand the specificities of the implementation of custodial socio-educational measures for female adolescents in the context of Santa Catarina. The research findings indicate that the presence of female adolescents within the socio-educational system remains marked by processes of institutional and social invisibility. Although the legal frameworks grounded in the Comprehensive Protection Doctrine represent significant normative advances, their implementation still faces limitations when confronted with structural inequalities shaped by relations of gender, class, and race.
