A presente pesquisa investiga se a Lei nº 12.318/2010 (Lei de Alienação Parental) tem atuado como instrumento de institucionalização da violência vicária nos processos de guarda e convivência. O problema que orienta o estudo consiste em verificar como a referida legislação tem sido utilizada para revitimizar mulheres em situação de violência doméstica e perpetuar o controle dos agressores por meio dos filhos no âmbito judicial. Parte-se da hipótese de que a aplicação da lei, desprovida de perspectiva de gênero, favorece estratégias defensivas de agressores e contribui para a revitimização de mulheres no contexto judicial. Para tanto, adotou-se abordagem qualitativa e método indutivo, fundamentados na teoria feminista, com revisão bibliográfica, análise jurisprudencial dos Tribunais de Justiça do Rio Grande do Sul (2015–2024), de Santa Catarina (2017–2020) e do Paraná (2024), além de estudo de caso. Os objetivos específicos consistiram em: examinar a origem da Lei de Alienação Parental e sua vinculação à teoria da Síndrome de Alienação Parental, identificando suas fragilidades conceituais; analisar as raízes históricas da violência contra a mulher e suas formas de manifestação à luz da Lei Maria da Penha, conceituando a violência vicária; e demonstrar, por meio da análise jurisprudencial, a intersecção entre alienação parental e violência doméstica, evidenciando como a aplicação da lei tem sido utilizada para desconstituir medidas protetivas e perpetuar a violência contra a mulher por meio dos filhos. Os resultados confirmaram a hipótese formulada: a alegação de alienação parental foi identificada como estratégia processual recorrente em contextos de violência doméstica, sendo utilizada para reverter decisões protetivas baseadas na Lei Maria da Penha e manter o acesso do agressor à vítima por intermédio da disputa pela guarda. Conclui-se, portanto, que a Lei de Alienação Parental tem sido aplicada de forma a institucionalizar a violência vicária, apontando-se a necessidade de sua revisão ou revogação, bem como da incorporação da perspectiva de gênero no Direito das Famílias. This research investigates whether Law No. 12,318/2010 (Parental Alienation Law) has functioned as an instrument for the institutionalization of vicarious violence in custody and visitation cases. The guiding problem of the study is to examine how the referred legislation has been used to revictimize women in situations of domestic violence and to perpetuate abusers' control through their children within the judicial system. The hypothesis is that the application of the law, devoid of a gender perspective, favors defensive strategies employed by abusers and contributes to the revictimization of women in judicial conteFor that, a qualitative approach and inductive method were adopted, grounded in feminist theory, comprising a literature review, case law analysis from the Courts of Justice of Rio Grande do Sul (2015–2024), Santa Catarina (2017–2020), and Paraná (2024), as well as a case study. The specific objectives were to examine the origins of the Parental Alienation Law and its connection to the Parental Alienation Syndrome theory, identifying its conceptual weaknesses; to analyze the historical roots of violence against women and its forms of manifestation in the light of the Maria da Penha Law, conceptualizing vicarious violence; and to demonstrate, through case law analysis, the intersection between parental alienation and domestic violence, highlighting how the application of the law has been used to overturn protective measures and perpetuate violence against women through their children. The results confirmed the proposed hypothesis: allegations of parental alienation were identified as a recurring procedural strategy in domestic violence contexts, being used to reverse protective decisions based on the Maria da Penha Law and to maintain the abuser's access to the victim through custody disputes. Therefore, it is concluded that the Parental Alienation Law has been applied in a manner that institutionalizes vicarious violence, pointing to the need for its revision or repeal, as well as for the incorporation of a gender perspective into Family Law. |
