Este trabalho analisa os impactos da Súmula Vinculante 24 do Supremo Tribunal Federal sobre a persecução penal da lavagem de dinheiro, especificamente nos casos em que a infração penal antecedente figura como crime material contra a ordem tributária. A pesquisa adota abordagem qualitativa, valendo-se de revisão bibliográfica, investigação normativa e análise jurisprudencial do Supremo Tribunal Federal e do Superior Tribunal de Justiça, complementada por estudo comparado dos ordenamentos jurídicos espanhol e português. O trabalho examina as bases teóricas da relação entre lavagem de dinheiro e crimes materiais tributários, situa o arcabouço normativo brasileiro frente ao padrão internacional estabelecido pelo GAFI e pelas convenções internacionais e verifica, por meio de análise jurisprudencial, como os tribunais superiores têm aplicado e mitigado o verbete. Sustenta-se a hipótese de que a exigência do lançamento definitivo do tributo, ao condicionar a consumação do crime material tributário, cria uma trava administrativa que esvazia a autonomia do tipo penal de lavagem de dinheiro. A análise jurisprudencial demonstra que os tribunais superiores tendem a solucionar esse impasse por meio da mitigação do verbete. A análise demonstra que a Súmula Vinculante 24 transformou-se em obstáculo à efetiva persecução penal da lavagem de dinheiro e que a mitigação judicial, embora pragmaticamente necessária, aprofunda a insegurança jurídica que o instituto visava originalmente pacificar. This work analyzes the impacts of Binding Precedent 24 (Súmula Vinculante 24) of the Brazilian Supreme Federal Court on the criminal prosecution of money laundering, specifically in cases where the antecedent criminal offense is a material crime against the tax order. The research adopts a qualitative approach, employing a literature review, normative investigation, and jurisprudential analysis of the Supreme Federal Court and the Superior Court of Justice, complemented by a comparative study of the Spanish and Portuguese legal systems. The study examines the theoretical foundations of the relationship between money laundering and material tax crimes, situates the Brazilian normative framework against the international standard established by the FATF (Financial Action Task Force) and international conventions, and verifies, through jurisprudential analysis, how the higher courts have applied and mitigated the precedent. It supports the hypothesis that the requirement of a definitive tax assessment, by conditioning the consummation of the material tax crime, creates an administrative barrier that diminishes the autonomy of the money laundering criminal offense. The jurisprudential analysis demonstrates that the higher courts tend to resolve this impasse by mitigating the precedent. The analysis concludes that Binding Precedent 24 has become an obstacle to the effective criminal prosecution of money laundering, and that judicial mitigation, although pragmatically necessary, deepens the legal uncertainty that the institute originally aimed to pacify. |
