O presente trabalho trata da conciliação na Justiça do Trabalho, perpassando o papel do conciliador e a abertura institucional à atuação voluntária de conciliadores externos e especializados, e tem como problema de pesquisa a seguinte indagação: em que medida e sob quais condições a ampliação do modelo conciliatório na Justiça do Trabalho, mediante a participação de conciliadores externos, voluntários e especializados, mostra-se juridicamente viável e compatível com o arcabouço principiológico do Direito do Trabalho (material e processual), de modo a promover a expansão quantitativa e qualitativa das soluções consensuais? Para responder a tal indagação, levanta-se a hipótese de que a ampliação do modelo conciliatório na Justiça do Trabalho, mediante a participação de conciliadores externos, voluntários e especializados, revela-se juridicamente possível e principiologicamente compatível com o Direito do Trabalho (processual e material). O principal objetivo deste trabalho é avaliar a viabilidade da inclusão de conciliadores externos, voluntários e especializados na Justiça do Trabalho, mediante a investigação de seus fundamentos teórico-normativos, da compatibilização principiológica com o Direito do Trabalho (material e processual) e da identificação dos requisitos técnicos e regulamentares necessários para a sua efetiva implementação. O método de abordagem utilizado foi o dedutivo e os procedimentos utilizados para buscar os objetivos foram o descritivo, analítico e argumentativo, e as técnicas empregadas foram as de análise bibliográfica e documental, comparativa e hermenêutica. Refletindo os objetivos específicos, expôs-se, no capítulo inaugural, a descrição dos fundamentos teóricos dos conflitos, do acesso à justiça e da justiça multiportas, bem como os métodos de solução de conflitos e a formação histórico-normativa da conciliação no Brasil. No capítulo intermediário foram caracterizadas a Justiça do Trabalho e a conciliação trabalhista e descritos os Princípios do Direito e do Processo do Trabalho, assim como os princípios da conciliação. No capítulo final, analisou-se a compatibilidade principiológica entre a conciliação e o Direito do Trabalho (processual e material), o papel do conciliador, os aspectos, técnicas e regulamentações da atuação conciliatória e se propôs a ampliação do modelo conciliatório mediante a participação de conciliadores externos, voluntários e especializados. Concluiu-se que a proposta de inclusão de conciliadores externos, voluntários e especializados na Justiça do Trabalho mostrou-se juridicamente viável e compatível com o arcabouço principiológico do Direito do Trabalho (material e processual), de modo a promover a expansão quantitativa e qualitativa das soluções consensuais. This study addresses conciliation within the Labor Justice system, examining the role of the conciliator and the institutional openness to the voluntary participation of external and specialized conciliators. Its research problem is framed by the following question: to what extent, and under what conditions, is the expansion of the conciliatory model in the Labor Justice system, through the participation of external, voluntary, and specialized conciliators, legally feasible and compatible with the principled framework of Labor Law, both substantive and procedural, so as to promote the quantitative and qualitative expansion of consensual solutions? In response to this question, the hypothesis advanced is that the expansion of the conciliatory model in the Labor Justice system, through the participation of external, voluntary, and specialized conciliators, is legally possible and principledly compatible with Labor Law, procedural and substantive. The main objective of this study is to assess the feasibility of including external, voluntary, and specialized conciliators within the Labor Justice system, through the investigation of their theoretical and normative foundations, their principled compatibility with Labor Law, substantive and procedural, and the identification of the technical and regulatory requirements necessary for their effective implementation. The methodological approach adopted was deductive, and the procedures used to achieve the objectives were descriptive, analytical, and argumentative, while the techniques employed included bibliographic and documentary analysis, as well as comparative and hermeneutic methods. Reflecting the specific objectives, the opening chapter presents a description of the theoretical foundations of conflicts, access to justice, and the multi-door courthouse model, as well as conflict resolution methods and the historical normative development of conciliation in Brazil. The intermediate chapter characterizes the Labor Justice system and labor conciliation, and outlines the principles of Labor Law and Labor Procedure, as well as the principles of conciliation. In the final chapter, the principled compatibility between conciliation and Labor Law, procedural and substantive, is analyzed, along with the role of the conciliator, the aspects, techniques, and regulations governing conciliatory practice, and a proposal is advanced for the expansion of the conciliatory model through the participation of external, voluntary, and specialized conciliators. It is concluded that the proposal to include external, voluntary, and specialized conciliators in the Labor Justice system proves to be legally viable and compatible with the principled framework of Labor Law, substantive and procedural, thereby promoting the quantitative and qualitative expansion of consensual solutions. |
