A relação entre Direito e Moral e suas consequências no âmbito do ativismo judicial no Brasil

Abstract

A presente pesquisa busca conhecer quais as consequências da fundamentação de decisões judiciais baseada em argumentos morais e seu potencial antidemocrático. Parte-se da hipótese de que a principal consequência é a ocorrência do fenômeno conhecido como ativismo judicial, e que este seria potencialmente degradante à democracia. Para isso, objetiva-se compreender o instituto da argumentação jurídica, as relações existentes entre direito e moral, suas consequências, bem como o fenômeno do ativismo judicial. Adotando-se o método dedutivo, a pesquisa estabeleceu uma análise geral dos conceitos e institutos para, em seguida, deduzir suas ocorrências específicas, principalmente no âmbito do Supremo Tribunal Federal (STF). Assim, o trabalho foi dividido em três capítulos. No primeiro capítulo centrou-se nas teorias da argumentação jurídica, seus principais expoentes e métodos de aplicação. No segundo, analisou-se as relações existentes entre direito e moral, inclusive como ela ocorre em decisões judiciais do STF e, por fim, quais as consequências dessa ocorrência. O terceiro capítulo estuda o fenômeno do ativismo judicial, apontado como uma das principais consequências do uso de argumentos morais em decisões judiciais. Abordando não apenas seus conceitos, como também sua ocorrência frequente no STF, destacou-se seu caráter antidemocrático e, portanto, perigoso para os Estados Constitucionais.

This research seeks to understand the consequences of judicial decisions based on moral arguments and their anti-democratic potential. It starts from the hypothesis that the main consequence is the occurrence of the phenomenon known as judicial activism, which could potentially undermine democracy. To this end, the objective is to understand the institution of legal argumentation, the relationships between law and morality, their consequences, as well as the phenomenon of judicial activism. Adopting the deductive method, the research established a general analysis of the concepts and institutions in order to then deduce their specific occurrences, mainly within the scope of the Federal Supreme Court. Thus, the work was divided into three chapters. The first chapter focused on the theories of legal argumentation, its main exponents, and methods of application. The second analyzed the relationships between law and morality, including how it occurs in STF judicial decisions and, finally, the consequences of this occurrence. The third chapter studies the phenomenon of judicial activism, identified as one of the main consequences of the use of moral arguments in judicial decisions. Addressing not only its concepts, but also its frequent occurrence in the Federal Supreme Court, its anti-democratic character and, therefore, dangerous for constitutional states, was highlighted.
