Herança digital: implicações jurídicas do crescimento exponencial da internet

Abstract

O presente Trabalho de Conclusão de Curso tem como objetivo analisar as implicações jurídicas do crescimento exponencial da internet na sucessão do patrimônio digital, investigando os desafios que o ambiente virtual impõe ao Direito Sucessório brasileiro. Diante da ausência de regulamentação específica, a pesquisa busca compreender de que forma os bens digitais, que podem possuir natureza patrimonial, existencial ou híbrida, se inserem no conceito de herança e como devem ser tratados sob a ótica da transmissibilidade causa mortis. Adotou-se metodologia qualitativa, com abordagem hipotético-dedutiva, mediante pesquisa bibliográfica e documental, examinando doutrinas, legislações, bem como projetos legislativos, especialmente o Projeto de Atualização do Código Civil. A análise permitiu constatar que os bens digitais representam uma nova categoria jurídica que desafia os limites da dogmática civilista, exigindo a conciliação entre os direitos patrimoniais dos herdeiros e os direitos da personalidade do falecido e de terceiros. Constatou-se, ainda, a necessidade de adoção de um modelo normativo flexível, que permita a transmissão de bens digitais patrimoniais enquanto protege, através da intransmissibilidade, os bens existenciais vinculados à intimidade e à privacidade. Para os bens híbridos, a pesquisa propõe, fundada na proteção de princípios constitucionais, a técnica do fatiamento conceitual, permitindo a transmissão apenas da parte patrimonial, resguardando a dimensão personalíssima dos bens. Conclui-se que o avanço normativo em curso, materializado nas discussões sobre a atualização do Código Civil, representa etapa essencial para a consolidação de um sistema sucessório digital coerente com as exigências éticas e tecnológicas da sociedade contemporânea. A pesquisa aponta, por fim, a necessidade de continuidade dos estudos sobre os limites da sucessão digital, a compatibilização com a proteção de dados pessoais e a construção de parâmetros interpretativos que preservem a dignidade da pessoa humana também no ambiente virtual.

This undergraduate thesis aims to analyze the legal implications of the exponential growth of the internet on the succession of digital assets, investigating the challenges that the virtual environment poses to Brazilian Succession Law. In light of the absence of specific regulation, the research seeks to understand how digital assets, which may have a patrimonial, existential or hybrid nature, fit within the concept of inheritance and how they should be treated from the perspective of transmissibility by death. A qualitative methodology was adopted, with a hypothetical-deductive approach, through bibliographic and documentary research, examining legal doctrines, legislation, as well as legislative proposals, especially the Draft Bill for the Updating of the Civil Code. The analysis revealed that digital assets represent a new legal category that challenges the boundaries of civil law dogmatics, requiring the reconciliation between the patrimonial rights of heirs and the personality rights of the deceased and third parties. It was also found that there is a need for the adoption of a flexible normative model that allows for the transmission of patrimonial digital assets while protecting, through intransmissibility, existential assets linked to intimacy and privacy. Regarding hybrid assets, the research proposes, based on the protection of constitutional principles, the technique of conceptual segmentation, allowing the transmission only of the patrimonial portion, while safeguarding the personal dimension of such assets. The study concludes that the ongoing normative progress, materialized in discussions on updating the Civil Code, represents an essential step toward consolidating a digital succession system consistent with the ethical and technological demands of contemporary society. Finally, the research highlights the need for continued studies on the limits of digital succession, its compatibility with personal data protection, and the construction of interpretative parameters that preserve human dignity within the virtual environment as well.
