A constituição do estado plurinacional boliviano: representação de um novo paradigma dos direitos humanos

Abstract

A presente tese tem como objetivo analisar a Constituição boliviana de 2009, observando como este se constitui desde sua elaboração até o texto final promulgado. A pesquisa foi realizada com base bibliográfica e documental, utilizando autores brasileiros e não brasileiros, no intuito de compreender as nuances que compõem este processo. Nossa análise é centrada na forma como a Constituição Política do Estado Plurinacional Boliviano foi conduzida, através da articulação dos sujeitos coletivos presentes na Bolívia: trabalhadores, indígenas e camponeses, e como isto se reflete em sua redação final, confrontando este processo com os limites estabelecidos aos direitos humanos pelo paradigma liberal. Como resultado deste intenso processo compreendemos que a abstração humana dá lugar a concretude apresentada pela figura dos sujeitos coletivos junto a nova Constituição boliviana, que também rompe com os limites impostos pela universalidade, proporcionando a construção de múltiplas instituições e políticas públicas que visem, de fato, atender as necessidades dos diversos grupos presentes na Bolívia na garantia de sua dignidade humana. Por fim, os limites apolíticos presentes na concepção liberal, adensados pelo projeto neoliberal, são removidos do processo, pois a intensa movimentação política durante a discussão da nova redação da Constituição se coloca evidente, bem como, em sua formatação final. Desta forma, podemos afirmar que a nova Constituição boliviana de 2009 representa um reflexo de um novo paradigma aos direitos humanos dentro de uma concepção de Estado Pluralista.

Abstract: This thesis aims to analyze the 2009 Bolivian Constitution, examining its formation from the drafting stages to the final promulgated text. The research was conducted through bibliographic and documentary sources, incorporating works by both Brazilian and non Brazilian authors, to capture the nuances of this process. Our analysis focuses on the manner in which the Political Constitution of the Plurinational State of Bolivia was shaped by the articulation of collective actors in Bolivia, including workers, indigenous peoples, and peasants, and how this is reflected in the final text. This process is juxtaposed with the constraints placed on human rights by the liberal paradigm. As a result of this intense process, we understand that the abstract notion of humanity gives way to the concreteness represented by the collective subjects in the new Bolivian Constitution, breaking away from the restrictions imposed by universality and enabling the creation of multiple institutions and public policies aimed at genuinely addressing the needs of Bolivia?s diverse groups in safeguarding their human dignity. Ultimately, the apolitical limits present in the liberal conception, intensified by the neoliberal project, are removed from the process, due to the intense political engagement during the drafting of the new Constitution as well as its final format. Therefore, we can assert that the 2009 Bolivian Constitution reflects a new paradigm of human rights within the framework of a Pluralist State.
