O encarceramento em massa e a política de alternativas penais no Brasil

Abstract

A presente dissertação tem por objetivo demonstrar a existência do encarceramento em massa no país e apontar alternativas para a superação desta realidade, com foco no sistema penal brasileiro. Para tanto, adentrou-se ao estudo da origem das penas, a fim de identificar sua progressão e finalidades na sociedade e nos dados do Sistema de Informações do Departamento Penitenciário Nacional ? SISDEPEN das duas últimas décadas, objetivando mensurar a evolução da população prisional por ano, no intuito de identificar a existência do encarceramento em massa e apontar alternativas à superação deste quadro, como as alternativas à prisão, com base nas categorias pena e crime. Foi necessário, por conseguinte, compreender a formação histórica das punições e quem é o sujeito do cárcere, partindo da análise das características da população prisional do país. Identificando os argumentos contrários e favoráveis à pena de prisão, no âmbito da literatura especializada, bem como as legislações vigentes e analisando o crescimento da população prisional do Brasil com a criação de vagas nas últimas décadas, averigua-se que essa não é capaz de acompanhar a velocidade do encarceramento. Dessa forma, a hipótese primária desta pesquisa é que o sistema prisional brasileiro amarga o encarceramento em massa, utilizando um modelo penal que tem no encarceramento o seu método preponderante e, a política de alternativas penais, por sua vez, é uma alternativa para o combate ao encarceramento em massa. A partir do levantamento teórico e de dados sobre o tema, as análises permitiram constatar o temerário alcance da ?eficácia? da pena privativa de liberdade e da necessidade de rever o sistema de aplicação de penas, com o intuito efetivo de atingir a diminuição dos níveis de criminalidade e reincidência, bem como alcançar a melhor resposta retributiva do Estado ao crime.

Abstract: This dissertation aims to demonstrate the existence of mass incarceration in the country and to point out alternatives to overcome this reality, focusing on the Brazilian penal system. To this end, we delved into the study of the origin of punishments, in order to identify their progression and purposes in society and in the data from the National Penitentiary Department Information System - SISDEPEN from the last two decades, aiming to measure the evolution of the prison population per year, in order to identify the existence of mass incarceration and point out alternatives to overcome this situation, such as alternatives to prison, based on the categories of punishment and crime. It was therefore necessary to understand the historical formation of punishments and who is the subject of imprisonment, starting from the analysis of the characteristics of the prison population in the country. Identifying the arguments for and against prison sentences, within the scope of specialized literature, as well as current legislation and analyzing the growth of the prison population in Brazil with the creation of vacancies in recent decades, it is found that it is not capable of keeping up with the speed of incarceration. Thus, the primary hypothesis of this research is that the Brazilian prison system suffers from mass incarceration, using a penal model that has incarceration as its predominant method, and that the alternative penal policy, in turn, is an alternative to combat mass incarceration. Based on the theoretical and data survey on the subject, the analyses allowed us to confirm the reckless scope of the ?effectiveness? of the custodial sentence and the need to review the system of application of sentences, with the effective aim of achieving a reduction in the levels of crime and recidivism, as well as achieving the best retributive response from the State to crime.
