O DEVER DE INDENIZAR NO DESCUMPRIMENTO DA ASSISTÊNCIA PARENTAL

Abstract

Este trabalho tem como objetivo investigar a responsabilidade civil aplicada ao descumprimento das obrigações parentais, especialmente no contexto da guarda compartilhada. A pesquisa busca investigar se a omissão na assistência parental configura ato ilícito capaz de gerar o dever de indenizar o genitor prejudicado, realizando uma análise de critérios para a concessão do direito à indenização, com objetivo de minimizar os impactos negativos decorrentes da falta de cooperação entre os pais. Com o uso do método indutivo, a pesquisa explora a evolução dos conceitos de família e das relações parentais sob a ótica constitucional, destacando a transição de um modelo patriarcal para um formato de cooperação e igualdade, fundamentado por princípios como dignidade humana, solidariedade e função social da família. A discussão aborda as novas formas de família, reconhecendo os novos arranjos familiares e a relevância da afetividade como elemento central das relações familiares modernas. A guarda compartilhada é analisada enquanto instrumento que possibilita o equilíbrio de responsabilidades entre os pais, buscando assegurar que ambos contribuam efetivamente para o bem-estar dos filhos. Além disso, o estudo considera o impacto das separações e os conflitos decorrentes da falta de assistência parental. Os resultados revelam que o descumprimento das obrigações parentais, em particular a negligência com o cuidado e apoio do genitor omisso, acarreta prejuízos emocionais e financeiros para o genitor guardião, justificando a aplicação da responsabilidade civil. Em última análise, o trabalho propõe que a aplicação da responsabilidade civil nesses casos atende ao superior interesse das crianças e adolescentes e aos interesses do genitor prejudicado, além de reforçar os direitos fundamentais inerentes à personalidade humana.

This study aims to investigate civil liability applied to the breach of parental obligations, particularly in the context of joint custody. The research is based on the premise that failure in parental assistance constitutes an unlawful act that gives rise to the duty to compensate the affected parent. This approach promotes an analysis of criteria for granting the right to compensation, seeking to minimize the negative impacts resulting from the lack of cooperation between parents. Using the inductive method, the study explores the evolution of family and parental relationship concepts from a constitutional perspective, highlighting the transition from a patriarchal model to one of cooperation and equality, supported by principles such as human dignity, solidarity, and the social role of the family. The discussion addresses new family forms, recognizing plural arrangements and the importance of affection as a central element in modern family relationships. Joint custody is analyzed as an instrument that enables a balanced distribution of parental responsibilities, ensuring that both parents contribute effectively to the child’s well-being. Additionally, the study considers the impact of separations and conflicts arising from lack of parental assistance. The results reveal that non-compliance with parental obligations, especially neglect of care and support by the non-compliant parent, causes emotional and financial harm to the custodial parent, justifying the application of civil liability. Ultimately, the study proposes that the application of civil liability in such cases serves the best interests of children and adolescents, as well as the interests of the aggrieved parent, while reinforcing the fundamental rights inherent to human personality.
