Constrained-off de Usinas Eólicas: análise preliminar da Consulta Pública 022/2022 da ANEEL.

Abstract

A energia eólica já está presente há muito tempo no Brasil e no mundo e vem crescendo cada vez mais, naturalmente, as Regulamentações antigas são atualizadas com o passar dos anos e novas vão surgindo, para sustentar tal crescimento. As usinas eólicas, assim como outras fontes de geração de energia, são impactadas com restrições de operação pelo Operador Nacional do Sistema Elétrico (ONS). Quando as mesmas são externas às usinas, são conhecidas pelo termo em inglês “Constrained-off”, mas apenas as restrições ocasionadas por razão de indisponibilidade das instalações externas às usinas é que são passíveis de ressarcimento. Apesar de ser algo que acontece com todas as fontes de geração, o foco do trabalho será nas usinas eólicas, devido à recente publicação da Resolução Normativa 1030/2022 e crescente discussão a respeito do tema. Inicialmente é apresentado a evolução da energia eólica no Brasil e no mundo, em seguida são trazidas a Resolução Normativa 1030/2022, que diz respeito à regulamentação do Constrained-off e às Notas Técnicas 0097/2021 e 0023/2022 que são um complemento à Resolução, tais documentos possuem a função de evidenciar como é regulamentado o Constrained-off atualmente, para que se possa ter um melhor entendimento a respeito do assunto. A metodologia utilizada foi a análise qualitativa dos dados, onde foram realizadas pesquisas, entrevistas e estudo da Consulta Pública 022/2022. A Consulta trata da coleta de subsídios para aprimoramento das Regras de Comercialização que circundam o Constrained-off, onde qualquer empresa pertencente ao setor poderia realizar a análise e sugestão a respeito das Regras de Comercialização destacadas na Consulta. Ao longo do estudo foram realizadas análises dos documentos fornecidos pelas empresas do setor de energia eólica, onde as mesmas sinalizam os pontos positivos e negativos das Regras de Comercialização, além de realizarem sugestões de melhorias. Por fim, o trabalho demonstra que existem muitas dúvidas e questionamentos por parte das empresas, com relação, por exemplo, aos tipos de contratos das usinas, utilização ou não da Garantia Física na determinação da energia contratada, além de entendimentos controversos a respeito de alguns assuntos, o que pode ser explicado pela recente discussão do tema e a quantidade imensa de documentos adjacentes à Resolução.

Wind energy has been prevalent in Brazil and worldwide for an extensive period, experiencing a steady and continuous growth over time, naturally, the old Regulations are updated over the years and new ones are emerging, to sustain such growth. Wind power plants, as well as other sources of energy generation, are affected through operational constraints imposed by Operador Nacional do Sistema Elétrico (ONS). When they are external to the power plant, known by the English term “Constrained-off”, but only the restrictions caused by the unavailability of facilities external to the power plants are eligible for refund. Despite being something that happens with all power generation sources, the focus of the work will be on wind power plants due to the recent publication of Normative Resolution 1030/2022 and growing discussion about the topic. Initially, the evolution of wind energy is presented in Brazil and around the world, and then the normative resolution 1030/2022 is brought, which concerns the regulation of Constrained-off, and technical notes 0097/2021 and 0023/2022 that are a complement to the resolution. Such documents have the function of evidencing how Constrained-off is currently regulated in order to have a better understanding of the subject. The methodology used was qualitative analysis of the data, where research, interviews, and a study of Public Consultation 022/2022 were carried out. The Consultation deals with the collection of subsidies to improve the Marketing Rules that surround the Constrained-off, and any company belonging to the sector could carry out the analysis and make suggestions regarding the marketing rules highlighted in the consultation. Throughout the study, analyses are carried out on documents provided by companies in the wind energy sector, where they indicate the positive and negative points of the Commercialization Rules, in addition to making suggestions for improvements. Finally, the study shows that there are many doubts and questions on the part of companies, regarding, for example, the types of contracts for power plants and the utilization or non-utilization of Physical Guarantee in determining contracted energy, in addition to controversial understandings regarding some subjects, which can be explained by the recent discussion of the subject and the immense amount of documents adjacent to the Resolution.
