Normas de gênero em curso de graduação em direito em cidade do sul do Brasil

Abstract

Esta tese trata de investigação das práticas organizadas pelas normas de gênero nas relações de poder no Curso de Graduação em Direito de uma universidade pública localizada no Sul do Brasil. Utilizando categorias teóricas orientadas pelo pós­estruturalismo feminista, o trabalho é desenvolvido por uma analítica das práticas discursivas e foi construído como uma pesquisa qualitativa, de caráter exploratório, com procedimento de revisão bibliográfica narrativa e levantamento por meio de entrevistas. Para cumprir com exigências éticas de investigação das práticas mencionadas, o projeto foi submetido e aprovado por Comitê de Ética em Pesquisa. Organizada em Modelo de Artigos, apresenta, como objetivo geral da pesquisa, compreender a organização das relações de poder por meio das normas de gênero no campo de pesquisa. Como objetivos específicos, propõe identificar epistemologias de teorias jurídicas feministas e pensar nas teorias jurídicas feministas com orientação pós­estruturalista como possibilidade de investigação do discurso jurídico; refletir, a partir de teorias jurídicas feministas pós estruturalistas, o discurso jurídico brasileiro associado ao sistema sexo­gênero; localizar os enunciados e a trama discursiva respectiva que se associam a normas de gênero e que orientam as relações de poder entre docentes e discentes no campo de pesquisa jurídico; identificar a política institucional de gênero da instituição de ensino superior pesquisada, refletindo sobre a organização das relações de poder a partir das normas de gênero. Como pressuposto epistemológico, a tese é guiada pelo pós­estruturalismo feminista, crítico do essencialismo e com uma compreensão do sujeito como efeito discursivo; e como pressupostos relacionais principais, seguem­se: (a) as normas de gênero, produzidas a partir do sistema sexo­gênero; (b) os sujeitos professora e discente, produzidos na instituição investigada. Os principais resultados alcançados por esta pesquisa são relacionados aos aportes científico, teórico e interventivo. No que se refere ao aporte científico, o trabalho representa uma pesquisa inédita, analisando, a partir da performatividade de gênero, especificamente, no ambiente universitário. Como aporte teórico, pressupõe­se a produção de conhecimento acerca de como as normas de gênero operam no campo da pesquisa e a consonância com as teorias já construídas sobre gênero em espaços institucionais de ensino e da atuação profissional em direito. Enquanto aporte interventivo, finalmente, pretende­se subsídios para a intervenção na interface entre Direito e Psicologia e bases para uma problematização e arguição teórica consistente a respeito da constituição dos sujeitos no campo estudado. Além disso, pretende­se, também, tomar tais bases para a promoção de ações reflexivas sobre a formação jurídica e a atuação profissional, bem como para promover um convite a refletir como as nossas práticas nos constituem e como não somos nós que formamos um discurso: é o discurso que nos forma.

This thesis is an investigation of practices organized by gender norms in power relations in the Law undergraduate course of a public university located in the south of Brazil. Using theoretical categories guided by feminist post­structuralism, the work is developed by an analysis of discursive practices and was constructed as a qualitative, exploratory research, with a narrative bibliographic review procedure and survey through interviews. To comply with the ethical research requirements of the aforementioned practices, the project was submitted and approved by the Ethics in Research Committee. Organized in as collection of research articles, this thesis seeks to understand the organization of power relations through gender norms in the research field. As specific objectives, it proposes to identify epistemologies of feminist legal theories and to think about feminist legal theories with a post­structuralist orientation as a possibility of investigating legal discourse; reflect, from post­structuralist feminist legal theories, the Brazilian legal discourse associated with the sex­gender system; locate the statements and discourses that are associated with gender norms and that guide the power relations between professors and students in the field of legal research; identify the institutional gender policy of this higher education institution, reflecting on the organization of power relations based on gender norms. As an epistemological presupposition, the thesis is guided by feminist post structuralism, making a critique to essentialism and the understanding of the subject as a discursive effect. and as main assumptions, the thesis considers (a) gender norms, produced from the sex­gender system; (b) the teacher and student subjects, produced in the institution. The main results achieved by this research are related to scientific, theoretical and interventional contributions. Regarding the scientific contribution, the work represents an innovative research, analyzing, from the gender performativity theory, specifically, in the university environment. As a theoretical contribution, it is presupposed the production of knowledge about how gender norms operate in the field of research and the consonance with the theories already built on gender in institutional spaces of teaching and professional practice in law. As a contribution for intervention, finally, the work intends to offer subsidies for the intervention in the interface between Law and Psychology and bases for a problematization as well as consistent theoretical argument regarding the constitution of subjects in this field. In addition, the thesis intends the promotion of reflexive actions on legal education and professional performance, as well as to offer an invitation to reflect on how our practices constitute us and how we are not the ones who form a discourse: it is discourse that forms us.
