As implicações jurídicas de transações comerciais realizadas por meio da tecnologia blockchain com criptomoedas

Abstract

O objetivo geral do presente trabalho é verificar as possíveis implicações jurídicas de transações comerciais realizadas por meio da tecnologia blockchain com criptomoedas. Tecnologia essa que trouxe mudanças e inovações, principalmente em relação ao sistema financeiro, o que possibilitou debates a respeito de suas implicações, inclusive regulatórias. Com o propósito de responder o problema envolvido no presente estudo: “quais as possíveis implicações jurídicas de transações comerciais realizadas por meio da tecnologia blockchain com criptomoedas?” elaborou-se levantamento bibliográfico, bem como de fontes relacionadas à legislação acerca do atual regramento e tratamento jurídico oferecido a essa tecnologia, possibilitando compreender as possíveis implicações jurídicas decorrentes. Os objetivos específicos foram três, são eles: a) apresentar como está atualmente estruturado o sistema monetário e sua evolução e os aspectos relacionados à regulação financeira; b) apresentar aspectos sobre criptomoedas, destacando seu surgimento, funcionamento da tecnologia blockchain e aplicações, especialmente enquanto moeda virtual; c) abordar os aspectos ligados às implicações jurídicas das transações comerciais realizadas com criptomoedas. Cada um desses objetivos corresponde a um dos capítulos que estruturam o trabalho. A hipótese da pesquisa foi verificada ao entender que existem implicações jurídicas de transações comerciais realizadas por meio da tecnologia blockchain com criptomoedas, em especial as relacionadas ao campo da própria definição legal de sua natureza jurídica, bem como acerca do caráter patrimonial dos criptoativos e a possibilidade de incidências de tributos nas relações comerciais decorrentes do uso de criptomoedas.

The general objective of this work is to verify if there are legal implications of commercial transactions carried out through blockchain technology with cryptocurrencies. This technology changes and innovations, mainly in relation to the financial system, which allowed debates about its implications, including regulatory ones. With the purpose of answering the guiding question: “what are the legal implications of commercial transactions carried out through blockchain technology with cryptocurrencies?” a bibliographical survey was elaborated, as well as of sources related to legislation about the current regulation and legal treatment offered to this technology, making it possible to understand the possible legal implications resulting from it. There were three specific objectives, namely: a) to present how the monetary system is currently structured and its evolution and aspects related to financial regulation; b) present aspects about cryptocurrencies, highlighting its emergence, the functioning of blockchain technology and applications, especially as a virtual currency; c) address aspects related to the legal implications of commercial transactions carried out with cryptocurrencies. Each of these objectives corresponds to one of the chapters that structure the work. The research hypothesis was verified by understanding that there are legal implications of commercial transactions carried out through blockchain technology with cryptocurrencies, in particular those related to the field of the legal definition of its legal nature, as well as about the patrimonial character of cryptoassets and the possibility incidence of taxes on commercial relations resulting from the use of cryptocurrencies.
