Manifestações públicas de exaltação a tortura: exercício da liberdade de expressão ou violação de Direitos Humanos?

Abstract

A prática da tortura foi um recurso amplamente utilizado pelos agentes da ditatura militar brasileira na perseguição aos dissidentes do regime, entre 1964 e 1985. Apesar de vivermos em um regime democrático desde então, manifestações públicas de exaltação a tortura e a torturadores reconhecidos pela justiça brasileira ainda são registradas, merecendo destaque aquelas proferidas pelo atual Presidente da República Jair Bolsonaro. O trabalho tem como objetivo analisar a natureza desses discursos, definindo se estão protegidos pelo direito à liberdade de expressão, bem como se são compatíveis com as normas de direito internacional para proteção dos Direitos Humanos. A metodologia escolhida consiste em uma abordagem teórica inicial acerca dos limites à liberdade de expressão, da relevância da proteção dos Direitos Humanos no ordenamento jurídico interno e no âmbito internacional e de uma contextualização histórica sobre a ditadura militar e seu legado para a segurança pública no Brasil. Posteriormente, foram selecionadas reportagens jornalísticas em quatro diferentes veículos de comunicação, no período entre 2018 e 2022, com as expressões chave “tortura”, “apologia à tortura”, “governo Bolsonaro” e “violência policial”. A análise das notícias selecionadas buscou identificar os impactos dessas condutas na realidade social e no fomento da cultura de violência policial. A partir dos resultados obtidos, conclui-se ser verdadeira a hipótese defendida, e que, portanto, as manifestações objeto da pesquisa devem ser compreendidas como uma violação aos Direitos Humanos. Nesse sentido, por fim, sugerem-se diferentes instrumentos jurídicos a permitir a responsabilização do agente pela prática da ilicitude.

The practice of torture was a resource widely used by agents of the Brazilian military dictatorship in the persecution of the dissidents who opposed the regime, between 1964 and 1985. Although we have lived in a democracy since then, public manifestations of incitement to torture and torturers, recognized as such by the Brazilian justice system, still take place, specially those given by the current brazilian President, Jair Bolsonaro. This research aims to analyse the nature of these discourses, clarifying whether they are protected by the right to free speech, as well as whether they are in accordance with international human rights law. The research methodology consists of an initial theoretical approach concerning the limitations on free speech, the relevance of the protection of the human rights within the nacional and internacional legal systems, and a historical background on the military dictatorship and its legacy for public security in Brazil. Then, news reports from four different media outlets were selected, regarding the period between 2018 and 2022, by using the key expressions "torture," "incitement to torture," "Bolsonaro administration" and "police brutality." The analysis of the selected news reports sought to identify the impacts of these conducts on social reality and by fostering the culture of police brutality. On the basis of the findings, we must therefore conclude that the held hypothesis was proven correct and, as a result, the incitement to torture speech must be understood as Human Rights violation. Ultimately, the paper aims to identify possible legal instruments that make it feasible to hold the agent accountable for the practice of the illicit behavior.
