A função de utilidade como mecanismo de maximização dos resultados da partilha amigável de herança

Abstract

O presente trabalho analisará se a função de utilidade é um mecanismo capaz de maximizar os resultados da partilha amigável de herança. Na primeira parte, são apresentados os conceitos de “bom acordo”. Na sequência, apresenta-se a definição e as características da função de utilidade, e também um meio de aplicá-la a negociações distributivas, qual seja, o sistema de alocação de pontos. Na segunda parte, discorrerá sobre como se dá a aplicação da função de utilidade a negociações sobre a partilha de herança. Primeiro, será feita a análise do conceito de “barganha à sombra da lei”, e depois, o conceito será aplicado às negociações de partilha de herança no Brasil. Verificar-se-á que o acordo é a opção capaz de melhor atender aos interesses das partes em uma partilha de herança. Posteriormente, serão descritas as maneiras como o sistema de alocação de pontos pode ser aplicado a negociações sobre partilha de herança, demonstrando-se a sua capacidade de agregar valor às negociações relativas à partilha de herança, maximizando os resultados obtidos. Por fim, são listados os fatores limitantes da aplicação da função de utilidade às negociações sobre a partilha de herança. Conclui-se que a função de utilidade é um mecanismo capaz de maximizar os resultados da partilha de herança, mas que existem fatores capazes de limitar sua aplicação a esses casos.

This project will verify whether utility function is a mechanism capable of maximizing the results of sharing inheritance. In the first part, the concept of a “good agreement” is presented. Next, there is the presentation of the definition and characteristics of utility function, as well as a way of applying it to distributive negotiations, which is through the point allocation system. In the second part, it is demonstrated how utility function can be applied to negotiations on sharing inheritance. First, the concept of “bargaining in the shadow of the law” is presented, then, the concept is applied to negotiations on sharing inheritance in Brazil. Based on that, it is noticed that the agreement is the option that best meets the parties' interests in sharing inheritance. Then, it is demonstrated how the point allocation system can be applied to negotiations on sharing inheritance, and how it is capable of aggregating value to negotiations on sharing inheritance, hence maximizing their results. Finally, the factors capable of limiting the application of utility function to negotiations on sharing inheritance are demonstrated. It is concluded that utility function is a mechanism capable of maximizing agreements on sharing inheritance, however, there are factors which limit its application to these cases.
