Cláusulas sucessórias no pacto antenupcial: exercício da autonomia privada no planejamento patrimonial do futuro casal

Abstract

O presente trabalho visa a refletir sobre a proibição da estipulação de cláusulas sucessórias, em especial, no pacto antenupcial. A pesquisa propõe abordar se a atual proibição de pacto sucessório, fundamentada pelo artigo 426 do Código Civil, possa estar interferindo na autonomia privada dos indivíduos, e, inclusive, na tomada de decisão destes com relação à formalização de relacionamentos amorosos. O estudo abordará se os motivos pelos quais a prática da cláusula sucessória é proibida a justificam, e se devem ser estendidos inclusive para as cláusulas que versem sobre renúncia antecipada abdicativa. Para tanto, será feita uma pesquisa bibliográfica baseada em doutrina, legislação, artigos e precedentes de alguns Tribunais nacionais, além de trazer alguns exemplos de ordenamentos estrangeiros acerca do tema. Por fim, pretende-se verificar se a lei deve ser alterada, a fim de viabilizar um importante instrumento que é o planejamento sucessório, que tem como principal objetivo proporcionar uma transição pacífica e fiel à última vontade de seu autor.

The present work aims to reflect on the prohibition of the stipulation of succession clauses, in particular, in the prenuptial agreement. The research proposes to address whether the current prohibition of succession agreements, based on article 426 of the Civil Code, may be interfering in the private autonomy of individuals, and even in their decision-making regarding the formalization of romantic relationships. The study will address whether the reasons why the practice of the succession clause is prohibited justify it, and whether they should be extended even to clauses that deal with early abdicative waiver. To this end, a bibliographic research will be carried out based on doctrine, legislation, articles and precedents of some national Courts, in addition to bringing some examples of foreign legal system on the subject. Finally, it is intended to verify if the law should be amended, in order to make possible an important instrument that is succession planning, which has as its main objective to provide a peaceful and faithful transition to the last will of its author.
