Responsabilidade civil em casos de acidente automobilístico por Veículo Autônomo: o caso Elaine Herzberg e seus possíveis reflexos no direito positivo brasileiro.

Abstract

O presente trabalho tem por objetivo a análise das possibilidades de aplicação da responsabilidade civil em casos de acidente envolvendo Veículo Autônomo, tendo como base o caso real do atropelamento de Elaine Herzberg por Veículo Autônomo da empresa Uber, ocorrido nos Estados Unidos. Inicia-se com um estudo básico, porém necessário, sobre o conceito de Inteligência Artificial e de Veículo Autônomo, com o fim de situar o leitor que não está familiarizado com esses termos. Após, apresenta-se o caso do acidente em si, com todas as circunstâncias que o cercaram e o que fora apurado pelas investigações. Adiante, parte-se para algumas considerações a respeito do instituto da responsabilidade civil, tanto históricas como doutrinárias, para contextualizar o leitor que não é da área jurídica a respeito desse instituto e de como ele é disciplinado pelo ordenamento jurídico brasileiro. Por fim, analisaremos como o caso foi disciplinado em solo americano e traçaremos um comparativo para tentar encontrar a melhor solução possível à luz do direito pátrio.

This research aims to analyze the possibilities of applying civil liability in cases of accidents involving autonomous vehicles, based on the real case of Elaine Herzberg being run over by Uber autonomous vehicles, which occurred in the United States. It begins with a basic but necessary study of the concept of Artificial Intelligence and Autonomous Vehicle in order to situate the reader who is unfamiliar with these terms. Afterwards, the case of the accident itself is presented, with all the circumstances that surrounded it and what was investigated. Subsequently, we start with some considerations about the institute of civil liability, both historical and doctrinal, to contextualize the reader who is not from the legal area about this institute and how it is disciplined by the Brazilian legal system. Finally, we will analyze how the case was disciplined on the USA and draw a comparison to try to find the best possible solution in the light of homeland law.
